Licensing Program Analysts (LPAs) Selina Siao and Elizabeth Rivera conducted unannounced inspection to deliver the above complaint finding. The initial inspection was conducted on 04/11/2019. Upon arrival, there were 7 children including 2 school age children at the facility while licensee's adult grand daughter were taking 3 of her cousins to their house.
Throughout the course of investigation, records were reviewed, and interviews were conducted with licensee, helper, several daycare parents and several day care children. Although Licensee denied that her son in law Terrance Johnson lived at the facility but the 30-day notice to terminate tenancy dated 03/18/2019 obtained from licensee listed him as a tenant. Based on information obtained and interviews conducted, and record review the preponderance of evidence standard has been met, therefore the above allegation regarding uncleared adult living in the home is found to be SUBSTANTIATED, California Code of Regulations, 102370(d) is being cited on the attached LIC 9099D. Civil penalty of $500 is being assessed today. This report was translated to licensee by LPA Elizabeth Rivera in Spanish.
“Upon receipt, licensee shall post and provide copies of this licensing report to parents/guardians of children in care at the facility and to parents/guardians of children newly enrolled at the facility during the next 12 months. “

Licensee stated that she will not allow any family members to stay at her house without the required background clearances and without having a contract with them.

This requirement is not met as licensee's son in law Terrance Johnson lived at the home or had prominate presence without the required background clearances. This poses an immediate health and safety risk to clients in care.

Licensing Program Analysts (LPAs) Selina Siao and Elizabeth Rivera conducted unannounced inspection to deliver the above complaint finding. The initial inspection was conducted on 04/11/2019. Upon arrival, LPAs met with licensee who is at the facility with 7 children along with her adult grand daughter.
Throughout the course of investigation, records were reviewed, and interviews were conducted with licensee, facility's helper, several daycare parents and several day care children.
Due to conflicting information obtained during the investigation, the allegation is found to be unsubstantiated which means that although the allegations regarding licensee failed to prevent daycare children from physical altercation, licensee yells at daycare children and licensee leaves daycare children with uncleared adult may have happened or may be valid, there is not a preponderance of the evidence to prove the alleged violations occurred. No citation issue. This report was translated to licensee by LPA Elizabeth Rivera in Spanish.
