25 | Licensing Program Analysts (LPAs) Yolanda Baez and Gloria Gonzalez arrived at the facility to conduct an unannounced Plan of Correction (POC) inspection. Upon arrival LPAs met with Licensee, Maclovia Rivero. Also present at the time of the inspection was helper, Maria Soriano. There were 16 children present at the time of the LPA's arrival, 1 infant (Licensee's infant son), 13 toddlers, and 2 School age children (Licensee's own school age daughter) and a school age day care child. Therefore, Licensee was over her capacity of 14 children.
Licensee's daughter was picked up by a family member within 5 to 6 minutes after the inspection began. Licensee's husband/ Co-Licensee Eduardo Magana arrived within 20 minutes after the inspection began to pick up Licensee's infant son. Licensee's capacity reduced to 14 children within 20 to 30 minutes after the inspection began. Licensee will become compliant with capacity (pending proof of enrollment of Kingergarten and Transitional Kindergarten for children in her care). LPAs observed there to be one rocker present, 2 exersaucers, and 1 bouncer present in accessible areas during the inspection (rocker was observed to be in Bedroom #3 and both exersaucers and 1 bouncer were observed to be in the living room near the chimney). Licensee stated that the exersaucers and bouncer is used for her own infant child and LPA advised to place prohibited items in an off limits area to ensure day care children to not have access to the prohibited items. Licensee immediately corrected the non-compliance and placed the two exersaucers and one bouncer in an off limits area. Licensee placed the rocker outside on the patio and stated that she would give it away. See LIC809D for cited deficiency. The licensee was provided a copy of their appeal rights (LIC 9058 12/15) and their signature on this form acknowledges receipt of these rights. Per Chapter 3, Division 12, Title 22 of the California Code of Regulations, upon receipt, licensee shall post and provide copies of this licensing report to parents/guardians of children in care at the facility and to parents/guardians of children newly enrolled at the facility during the next 12 months. NOTICE OF SITE VISIT IS TO BE POSTED FOR 30 DAYS. LPA observed licensee post notice of site visit.
