On 08/15/2024, at 12:00 PM, Licensing Program Analyst (LPA), Daniela Huerta conducted an unannounced complaint inspection to deliver findings for the above listed allegations. LPA met with Licensee, Diylan Xochitl and advised licensee of the purpose of the inspection and conducted a tour of the facility. There were two (2) children present and one (1) staff and licensee during the inspection.

During the course of the investigation, interviews were conducted with licensee, one (1) staff, seven (7) daycare children, and five (5) daycare parents. The facility roster and records were obtained and reviewed by LPA.

It was alleged that on multiple occasions, the licensee left daycare children in soiled diapers for a long period of time. Licensee and staff denied the allegation, indicating that staff check and changed diapers, if needed, at least 4 times throughout the day. Multiple daycare children interviewed stated that they have observed staff change diapers at the daycare throughout the day.

Daycare parents interviewed expressed satisfaction with the care the licensee provides and had no concerns with diaper changing practices at the day care with the exception of one parent, who is also a relative of alleged victim.

It was also alleged the licensee speaks to daycare children in an inappropriate manner. The licensee and staff interviewed denied the allegation, stating that if a child is misbehaving, they speak with the child and redirect challenging behaviors. Daycare children interviewed stated they have not been spoken inappropriate by licensee or staff, nor have they observed anyone else being spoken in an inappropriate manner.

Due to conflicting information obtained throughout the course of the investigation and no other witnesses to the alleged incidents, LPA was unable to determine whether or not the allegation occurred. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation(s) did or did not occur, therefore the allegation is UNSUBSTANTIATED.

Exit interview conducted and report was reviewed with licensee, Xochil Diylan. A copy of this report, along with Appeal Rights (LIC9058 03/22), was provided. A Notice of Site Visit was given and must remain posted for 30 days. LPA observed that the notice of site visit was posted during the inspection. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
