On June 2, 2022 at 10:00 AM, Licensing Program Analyst (LPA) Jo Ann Legaspi conducted an unannounced Annual Required Inspection and an inspection to examine the new proposed additional outdoor play area. LPA met with the Licensee Maria Hernandez and disclosed the purpose of the inspection and was granted facility entry by the Licensee. The Licensee, one (1) staff and three (3) children, ages 2 – 2 ½ years were present in the facility during this inspection. This facility is a three (3) bedroom, three (3) bathroom house with one floor. Licensee accompanied LPA during this inspection. The following areas used for childcare are: one (1) bathroom, dining room, living room, family room, secondary family room and fenced and shaded backyard; the Licensee would also like to use the front side yard. The off limit areas are the bedrooms, remaining bathrooms and kitchen. The kitchen is made inaccessible using child safety gates. The remaining off limit rooms are made inaccessible through use of door safety knobs.

The fire extinguisher, smoke detector, and carbon monoxide detector met requirements. Hazardous items were observed inaccessible to children during this inspection. The Licensee has available toys, play equipment and materials. Children play outside in the fenced and shaded backyard. Licensee was reminded that continuous supervision is to be given to children whenever engaged in outdoor activities. No bodies of water were observed on the premises during the inspection. Licensee stated there are no weapons in the home. The proposed front side yard was inspected and found to be appropriate for the children. Access to this proposed front yard is through its front gate and another gate which leads into the backyard. Parents will conduct child deliveries and retrievals at the front gate of this proposed play area; at other times, the front gate will be locked.

Licensee’s First Aid and CPR certifications expire in March 2024. Licensee has required immunizations. Mandated Reporter Training was completed on 05/15/2022. The facility roster is maintained and was reviewed. The last fire and disaster drills were conducted and documented on 03/17/2022.

Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.

LPA discussed the safe sleep regulations with Licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

LPA reminded Licensee of the following: Report suspected child abuse and neglect, maintain children’s records according to regulation, post all required forms, and ensure that all adults residing or working in the home have criminal background clearances or exemptions. Licensee was reminded that corporal punishment, smoking, exersaucers, bouncy seats, walkers, and jumpers and/or similar equipment are not allowed in daycare.

Incidental Medical services (IMS) policy was discussed. For IMS information see Evaluator Manual – Regulation Interpretations and Procedures for Family Child Care Homes Section 102417. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. No deficiencies observed. The proposed additional outside play area is approved for use by the children.

A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. Exit interview conducted and report was reviewed with the Licensee Maria Hernandez.
