Licensing Program Analysts (LPAs) Vicky Williamson and Adrian Castellon conducted an unannounced complaint inspection for the purpose of delivering complaint findings in regard to the above allegations. LPA Adrian Castellon aided as a Spanish translator. LPA met with Licensees, Marivel Portugal and Octavio Parra. There were 7 daycare children present, 2 of whom was under 24 months. It was alleged that licensee allowed a daycare child to sleep in a car seat, an unclear adult is providing care and supervision to daycare children, licensee failed to provide adequate supervision to daycare children, licensee denied authorized representative to enter the home during operating hours, and licensee left a daycare child in wet clothing. Interviews were conducted with licensees, a helper, several daycare children and daycare parents. Child #1 is non-verbal and other children involved were not available to be interviewed. Licensees and helper denied the allegation and state that the daycare children are never left in car seats. Licensees and helper states that the car seats are left at the front door of the facility when the children are dropped off at the facility by their parents. Daycare children and parents expressed no concerns regarding children being left in car seats.

Information received indicated that there is an unclear adult working in the facility as a helper, however the name of the adult is unknown. Licensees denied the allegation and stated that all adults living and working in the home have criminal record clearances. Licensees’ helper Maria Quinterotirado was present during LPA’s inspection on 11/5/19 & 11/25/19 and has completed a criminal background record clearance. Daycare children interviewed disclosed only the names of the adults working at the facility that have received criminal record clearances. Daycare parents interviewed were not sure of the names of the helpers that work at the facility, however expressed no concerns regarding an unclear adult working or residing at the home. Based on the evidence gathered there was no evidence to prove or completely disprove that an uncleared adult worked or had a presence in the facility.

Information received indicated that child #1 sustained scratches on the face area due to licensees not providing adequate supervision to daycare children. Licensees and helper denied the allegation and stated that there is always a licensee and a helper present at the facility and that supervision is always provided to the children. Licensees and helper states that parents are always made aware of any injures observed to their child while at the facility or upon entry to the facility. Daycare parents interviewed expressed no concerns regarding adequate supervision not being provided to daycare children.

Per licensees and helper, they have never denied any daycare parents or authorized representatives, entry into the facility. Licensees and helper state that some daycare parents stand outside of the front door or inside of the living room area of the facility by their choice. Daycare parents interviewed stated that sometimes during pick up of their children, they have remained on the outside of the facility. The same day parents acknowledge that they have entered the facility to pick up their children at some point during their child’s enrollment at the facility. A few of the daycare parents state that licensees and helper answer the front door when they arrive to pick their children up from the facility, advise them to, “hold on a minute,” then closes the door and proceed to retrieve the children from the inside of the facility. Daycare parents disclosed that licensees and helper have never verbally stated that they are not allowed to come inside of the facility. Daycare children interviewed stated that sometimes their parents come inside of the facility to pick them up and sometimes they wait outside. LPAs observation on 11/25/19, was that a daycare parent entered the facility and walked into the daycare room to pick up her child.

Information received indicated that licensee left child #1 in in wet clothing during the pick- up of the child from the facility. Licensees and helper denied the allegation and state that the children's clothing and diapers are always changed prior to the child being removed from the facility. Documentation received indicated that child #1 had clothing on that was wet on the bottom portion of the clothing the child was wearing; however, there is not enough evidence to provide proof that the bottom portion of the outfit became wet while the child was in care at the facility.

Based on LPAs observation, documentation, interviews conducted with licensees, a helper, several daycare children and daycare parents. LPA determined there was inconsistent information obtained resulting in a lack of evidence to support the allegations. Due to conflicting statements obtained during the course of the investigation, the above allegations are found to be unsubstantiated meaning that although the allegations may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged violations occurred.

No deficiencies cited. Licensee was provided appeal rights (LIC9058 01/16) and the signature on this form acknowledges receipt of these rights. Notice of Site Visit (LIC 9213) was provided to be posted at the facility for 30 days. LPA observed Notice of Site Visit (LIC 9213) posted.
