LPA A Locano completed un-announced complaint investigation visit to the facility today, to deliver final findings on allegations listed above, pertaining to Personal Rights. LPA met with Licensee Wilfredo Rodriguez, to delivered final findings on allegations as follows:

Regarding allegations stating that day care provider(s) engaged in verbal altercation in the presence of day care children and threw objects in the presence of day care children, per complete review of all information which included visit to the facility, interviews with both licensees, children, contact with parents and review of video surveillance of the exterior of the facility, there was no evidence to prove or completely disprove the allegation. Even though licensees state that the allegations are not true and they feel the allegations have been made by a parent who failed to meet her financial obligations to the facility, there is no concrete evidence to prove or completely disprove the allegations. As such, although the allegations may have happened, or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore, the allegations are UNSUBSTANTIATED, no violations issued to facility at this time. Final findings determined to be unsubstantiated. Licensee was provided a copy of appeal rights (LIC 9058 12/15) and signature on this form acknowledges receipt of these rights.


Regarding allegations stating that day care provider used inappropriate form of discipline and day care provider made inappropriate comment towards day care child, per complete review of all information which included visit to the facility, interviews with both licensees, children, contact with parents, review of discipline procedures, where licensees stated no inappropriate discipline is ever used on any child and review of video surveillance of the exterior of the facility, there was no evidence to prove or completely disprove the allegation. Even though licensees state that the allegations are not true and they feel the allegations have been made by a parent who failed to meet her financial obligations to the facility and it is noted LPA was not allowed to interview children pertaining to allegations, there is no concrete evidence to prove or completely disprove the allegations. As such, although the allegations may have happened, or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore, the allegations are UNSUBSTANTIATED, no violations issued to facility at this time. Final findings determined to be unsubstantiated. Licensee was provided a copy of appeal rights (LIC 9058 12/15) and signature on this form acknowledges receipt of these rights and copy of LIC 9213, “Notice of Site Visit,” and observed posting of notice during visit.
