On March 9, 2022 at 9:40 AM, Licensing Program Analyst (LPA), Marie Hernandez conducted an unannounced annual inspection and case management due to an increase of capacity. On 12/13/2021, the Department received an application for a large family child care from the Licensee. On 01/14/2022, the Chula Vista Fire Department approved the fire clearance for a large day care of capacity of 14 children. LPA met with the Licensee Alma Contreras. LPA disclosed the purpose of the inspection and was granted entry into the facility by the Licensee. There were no children present during the inspection today. The Licensee stated she does not have any children enrolled in her day care since licensure of 10/29/2019. This facility is a two story home. The following areas are used for child care: The dining room, living room, day care room, the downstairs hallway bathroom and the backyard. The off limit areas are the entire second floor, kitchen and the garage. The second floor, the kitchen and the garage are made inaccessible to children through the use of a child safety gate and locked door. The operation hours are Monday through Sunday from 6:00 AM to 5:00 AM.

The fire extinguisher, smoke detector, and carbon monoxide detector met requirements, per LPA observation. The hazardous items were inaccessible to children in care. LPA informed licensee that poisons shall be placed in a storage area and locked at all times. LPA observed toys, play equipment and materials available for the children’s use. The home has a fenced backyard available for outdoor activities of children. The licensee was informed that children shall be supervised during outdoor activities. Licensee stated there are no bodies of water on the premises and LPA did not observe any bodies of water during the inspection. Licensee stated there are no weapons in the home. A review of staff records on this date indicates that all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse clearances or exemptions. Licensee’s First Aid and CPR certifications are valid and expire on 10/2023. Licensee has required immunization's, per file review. Licensee’s Mandated Reporter Training expires 11/01/2023. LPA reminded licensee Mandated Reporter training shall be completed once every two years. There are no children records, fire/disaster drills or child roster to review as the Licensee does not have any children enrolled since 10/29/2019. See LIC 809C continuation...

The Licensee currently does not plan on providing IMS to clients. Incidental Medical Services (IMS) policy was discussed. For IMS information see Evaluator Manual - Regulation Interpretations and Procedures for Family Child Care Homes Section 102417. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. The following information regarding ADA was provided: US Department of Justice (USDOJ) toll-free ADA Information Line at (800) 514-0301 (voice)/ (800) 514-0383 (TTY) and link to the publication: Commonly Asked Questions about Child Care Centers and the ADA, available at: http://www.ada.gov/childqanda.htm.

The Licensee was reminded that all adults 18 and over living in the home, persons who provide care and supervision to children, and staff who have contact with children, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.

LPA discussed the safe sleep regulations with Licensee and discussed the Child Care Licensing Safe Sleep web page at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed Licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

LPA reviewed with Licensee the LIC 311D, Forms/Records To Keep In Your Family Child Care Homes, children’s forms/records, facility forms/records, and information to be posted.

Community Care Licensing Division (CCLD) regularly sends information to licensed facilities, providers, and stakeholders by way of Provider Information Notices (PIN), Program Quarterly Update Newsletters and other important information communication platform.

Effective today, 03/09/2022, the Licensee is approved for a large family child home for no more than fourteen children at any given time. LPA discussed and provided the ratio and capacity visual handout for a large family child care. The Licensee was advised that when there is no qualified assistant present, the capacity reverts back to the requirements for a small family child care home. The Licensee was also provided the ratio/capacity visual handout for a small family child care home. The Licensee stated it is understood and she will comply with the requirements and regulations at all times.
