enforcement. Law enforcement returned C1 to the daycare between 2:51 – 2:59 PM. Both the Licensee and S1 report that during the incident S1 was left alone with eleven (11) daycare children while the Licensee was gone conducting child transportations. S1 stated they were unaware C1 left the daycare until law enforcement returned C1 to the daycare.
The preponderance of evidence standard has been met; therefore, the above allegation is found to be SUBSTANTIATED. California Code of Regulations, (Title 22, Division 12 & Chapter 3), is being cited on the attached LIC 9099D and an immediate civil penalty of five hundred dollars ($500), is being assessed for the absence of supervision on the attached LIC 421IM, H&S section 1597.58(c)(2).
LPA Legaspi informed Licensee that this report dated 04/18/2022 documents a type A citation which shall be posted for 30 consecutive days as there is an immediate risk to the health, safety, and personal rights of children in care.
LPA Legaspi also informed the Licensee to provide a copy of this licensing report dated 04/18/2022 that documents the Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in each child's file for verification. LPA provided Licensee with a blank LIC 9224 form.
A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. Exit interview conducted and report was reviewed with the licensee Elvia Martinez. |
