13 | On 12/08/21 at 11:30am, Licensing Program Analyst (LPA) Adrian Castellon conducted an unannounced inspection to deliver complaint findings for the above allegation. LPA Castellon met with facility assistant Mabel Meza and discussed the purpose of the inspection. A second assistant was also present. It was alleged that the facility is operating out of ratio. During the course of the investigation, three unannounced inspections were conducted. Interviews were conducted with facility staff and an analyst from an outside agency. LPA Castellon also obtained a report from an outside agency. Even though licensee has a large capacity license, per age regulation ratios pertaining to infant children in care under 2 years of age, the maximum number of infant children under 2 years of age, allowed to be present in the facility with a large license, is 4 infants. Based on the licensee's admission and the outside agency's report, the allegation of facility being out of ratio is substantiated. The facility on at least one date had five infants present. As such, the preponderance of evidence standard has been met, therefore the above allegation of facility being out of ratio is found to be SUBSTANTIATED. Violations of the California Code of Regulations, Tittle 22, are being cited on the attached LIC9099D. Final findings delivered as substantiated, a type ‘B’ violation is being issued, as the situation posed a potential risk of proper care, for the 5 infant children present in the facility.
A copy of today's report, Notice of Site Visit and appeals rights given to the licensee. An exit interview was conducted with the licensee and licensee stated that she understood. Licensee were advised acknowledgement of receipt of the report is to be received via email. Notice of Site Visit should be posted for 30 days from today's date. |
