On 06/02/2023 at 9:15am, Licensing Program Analyst (LPA), Samantha Clenista, conducted an unannounced visit for the purpose of a random inspection. Upon arrival, LPA met with Aimee Schmidt, Site Coordinator. There was a total of 2 day care children present in care with Ms. Schmidt. Facility is currently licensed to operate in Rooms 20, 24, 25, 26, 27 and the multipurpose room, however, is currently only using 25 and 26. Facility is in the process of moving due to the demolition of some of the currently licensed rooms. Ms. Schmidt is reminded that any changes to the facility must be reported to and approved by Community Care Licensing. Ms. Schmidt stated that this school year will end 06/09/23, and the new school year will start 08/23/23.

Per Health and Safety Code Sections 1596.806(a), (a)(1), (1)(2) and (d) this program is exempt from square footage, fencing, outdoor activity space, toilet and isolation requirements. Ms. Schmidt stated that the facility uses the grassy field and blacktop area across Room 26 for outdoor play. LPA inspected Room 26. Room was equipped with tables and chairs and age appropriate equipment. Drinking water is readily accessible via water jugs and water cups/water bottles. Snacks are provided and prepared in the classroom. Classroom has storage space for food. There is an operational carbon monoxide detector in Room 26. Sign-in/out area is located in front of the bungalows. Ms. Schmidt was reminded to keep anything that reads, “Keep Out of Reach of Children” to be inaccessible to children. Medications, when present, are stored in a locked cabinet, inaccessible to children. All hazardous items are stored where they are inaccessible to children. Last fire drill was conducted on 05/31/23. Staff and child files were reviewed and observed to be complete. Ms. Schmidt has current CPR/First Aide certificate, AB1207 certificate and immunization records per SB792. Ms. Schmidt is reminded the Mandated Reporter Training is to be retaken every two years and can be accessed at the following website: www.mandatedreporterca.com

This facility provides Incidental Medical Services – IMS. LPA reviewed storage of medication and equipment/supplies, and reviewed children’s, personnel, and administrative records. For IMS information see Evaluator Manual – Regulation Interpretations and Procedures for Child Care Centers Sections 101173 and 101226. No services are in place today.

Child Care Providers can now sign up for Quarterly Updates and PINS through the DSS website at https://cdss.ca.gov/inforesources/community-care-licensing/subscribe. LPA discussed California Megan's Law with provider and advised her to go on the website at www.meganslaw.ca.gov.

Director was reminded that all adults 18 and over, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.

Per AB 2370, all that are located in buildings constructed before January 1, 2010, must have their water tested and post the results by January 1, 2023, and every 5 years after the date of the first testing. Director stated that the school district conducted a lead test of the faucets located at the facility, however the facility has not, and could not provided LPA with the testing results or required forms needed during time of inspection.

See 809D for Type B citation issued during time of inspection. A notice of site visit was given and must remain posted for 30 days. Failure to keep notice posted will result in a civil penalty of $100.00. Exit interview conducted and report was reviewed with Ms. Schmidt. Based on record review and interview with Director, the licensee did not comply with the section cited above as the facility stated there was a lead test that was conducted (date unknown), however could not provide proof of results or sampling paperwork to LPA during inspection, which poses/posed a potential health, safety or personal rights risk to persons in care.
