On 3/7/2023 at 10:40am, Licensing Program Analyst (LPA) Selina Siao conducted an inspection to deliver the above complaint finding. The initial inspections was conducted by LPA Siao on 1/18/2023 and 2/08/2023. LPA met with Director Rashelle Cultrera who was in the kitchen preparing food. Appropriate ratios were observed by LPA.
Throughout the course of investigation, interviews were conducted with several day care parents and all the staff members that works in the infant and toddler classrooms. Name to face child supervision records for the week of 1/3/23 to 1/06/23 and the children's attendance records were reviewed. On 1/3/2023, facility was operating out of ratio for about five minutes in the morning per review of records. One teacher supervising five infants as the fifth child was dropped off at 7:20am and the second staff did not arrive to class until 7:25am. Based on statements obtained, there has been incidents that the facility is out of ratio in the morning due to a staff member being late to work. The preponderance of evidence standard has been met, therefore the above allegation is found to be substantiated. See type B citation issued on LIC 9099D. Appeal Rights were discussed and provided. Notice of Site Visit was posted during this visit and will remain posted for 30 days.

Staff-Infant Ratio
There shall be a ratio of one teacher for every four infants in attendance. This requirement is not met as evidence by: On 1/3/2023, facility was operating out of ratio for about five minutes in the morning per review of records.

Director stated that she adjusted the staff members hours by having another staff takes over the shift of the staff that was struggling to be at work on time during mid January 2023.

Statements obtained, there has been times that the room was out of ratio due to a staff being late to work. This poses a potential health and safety risk to clients in care.

Director will remind all infant and toddler staff to ask the parent to stay or seek help to ensure that the facility remains in ratio at all times. Training agenda and staff members sign in sheet shall be submitted to LPA by 3/14/2023 .

Throughout the course of investigation, interviews were conducted with several day care parents and all the staff members that works in the infant and toddler classrooms. Teacher's transcripts were obtained and reviewed, based on records reviewed, interviews and observations, the allegation contradicts with the available evidence. Therefore the above finding is unsubstantiated, which means although the allegation may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged violation occurred. No citation issue. Appeal Rights were discussed and provided. Notice of Site Visit was posted during this visit and will remain posted for 30 days.
