On 10/20/2021 at 9:10am, Licensing Program Analysts (LPAs) Selina Siao and Samantha Clenista conduct an annual inspection. Upon arrival, LPAs met with Director Darla Rodriguez and proceeded to tour the facility. There were 37 children in care. The following ratios were observed Big Nest (4 year old room) had 13 children supervised by teachers Charles Borsavage, Amy Jimenez and Catherine Manuccia. Robins (3 year old room) had 10 children supervised by teacher Kim To. Canaries (2 year old room) had 14 children supervised by teacher Linda Lynch and Substitute teacher aide Araceli Curiel Cuevas.

Facility is within staffing ratio. All required notices, forms and licenses were posted. Furniture and age appropriate equipment is in good condition. Rooms have adequate heating, lighting and ventilation. Storage cubbies are readily available, and room accommodates class size. Napping equipment consists of mats which are kept in classroom and each mat has its own sheet or covering. Bathrooms are maintained with operational toilets and faucets with appropriate temperature. Paper towels and toilet paper are available. Bathroom is lighted and has ventilation. Food service area consists of a kitchen which is clean and free of hazards. Menu is posted. Adequate food is available for snacks. Cleaning supplies are kept up high and inaccessible to children. Outdoor play area is a fenced playground with sufficient turf for cushioning. Climbing structures and slides are securely fixed to the ground. Areas has buildings and trees used for shade. Equipment is age appropriate and separated by age groups, infant and preschool.

Based on observation today, the facility did not comply with the section cited above in 1 out of 7 staff fingerprint is not associated to the facility. Substitute teacher aide Araceli Curiel Cuevas fingerprint has not been transfer to the facility and she has been working at the facility for three days which poses a potential health, safety or personal rights risk to persons in care.

Director stated that she will be sure to submit the criminal background transfer request for all staff including substitute staff prior to having them in the classroom. Director provided the required transfer documents to Analyst during today's inspection. Civil penalty of $300 is being assessed.

All 37 children in care are not wearing a face covering or mask when they are inside the classroom as required by the San Diego County and Center of Disease Control mandates which poses a potential health, safety or personal rights risk to persons in care.

Child Care Providers can now sign up for Quarterly Updates and PINS through the DSS website at https://cdss.ca.gov/inforesources/community-care-licensing/subscribe. LPA discussed California Megan's Law with provider and advised her to go on the website at www.meganslaw.ca.gov.

The facility has sufficient Personal Protective Equipment (PPE) and understand that current County requirements state that all staff regardless of vaccination, are to wear masks while indoors. Reporting requirements for positive Covid-19 results in children or staff were discussed to include contact with County Department of Public Health for guidance (619)692-8499 and Licensing (619)767-2248 within 24 hours to report the unusual incident.

Director Darla Rodriguez was reminded that all adults 18 and over, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.

Each child brings their own water bottle from home and it is available for the children when they are inside the classroom and out at the playground. The playgrounds are free of debris or potential hazards. LPA reviewed sign in sheets, first aid supplies and reviewed medication policy and storage, all areas are within compliance. Isolation area is the Director's office. Personnel and client records were reviewed and staff members have the required immunizations and completed the online mandated reporter training. Reporting requirements was also reviewed. All personnel have required criminal record and child abuse index clearances. Substitute teacher aide Araceli Curiel Cuevas is not associated to the facility. LPA reviewed Emergency Disaster Plan and last fire drill was conducted on 08/05/2021. Facility has an operating carbon monoxide detector. Facility has multiple staff members with a valid EMSA approved CPR and First Aid certificates when children are in care.

Incidental Medical Services (IMS) policy was discussed. For IMS information see Evaluator Manual - Regulation Interpretations and Procedures for Child Care Centers Sections 101173 and 101226. When any IMS is provided, an updated Plan of Operation that includes IMS must be submitted to the Department. The following items were discussed with provider: Director was reminded that corporal punishment, smoking are not allowed in day care. Director was provided with information about Heat Related Illness, Best practice on supervision and reporting responsibilities were discussed.
