Licensing Program Analysts (LPAs) Selina Siao and Dana Stevens conducted an unannounced inpsection to investigate the above complaint allegation. Upon arrival, LPAs met with Director Christine Collins and conducted a tour of all the classrooms. Analysts obtained a list of the names along with the children's date of birth for the two toddler classrooms. Director stated that they moved two of the older infants that are under 18 months into the toddler Sea Horses classroom, an age exception letter was submittted to Licensing on August 14, 2019. A copy of the age exception letter request for the two older infants was obtained today.
Based on information obtained and Director's statement and record review, the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED, California Code of Regulations, 101216.4 (a)(2) are being cited on the attached LIC9099D.
Appeal Rights (1/16) were discussed and provided. Signature at the bottom of this report confirms receipt. Notice of Site Visit was posted during this visit and will remain posted for 30 days.

Preschool Program with Toddler Component
The toddler program shall be conducted in areas physically separate from those used by older or younger children. Space planning and usage for the toddler component shall be governed by the provisions of Section 101438.3. Plans to alternate use of outdoor play space must be approved by the Department.

This requirement was not met as evidence by: Two infants that are under 18 months have been placed in the toddler Sea Horses class prior to department's approval. This poses a potential health and safety risk to clients in care.
