On 8/31/22 at 2:32pm, Licensing Program Analyst (LPA), Martha Malane conducted an unannounced annual inspection and met with Director, Jhoanna Rios and Program Director, Sydney Lara. LPA disclosed the purpose of the inspection and was led on a tour of the facility. This is PM program which operates on a traditional school year schedule. Days and hours of operation are M/T/W/F 2:10pm – 6:00pm and Thursday 12:15pm – 6:00pm in the cafeteria and room 9.

At 2:40pm in the cafeteria, LPA counted the children and there were 31 children being supervised by two (2) staff members. (See next page LIC809D for deficiency cited). At 2:50pm, Director, Jhoanna Rios arrived in the cafeteria with five (5) children.

Director stated there are no bodies of water on the premises and LPA did not observe any bodies of water. Director stated there are no firearms or ammunition allowed or stored on the premises. Disinfectants, cleaning solutions, medication and other hazardous items are made inaccessible. No poisons were observed.

Furniture and equipment are in good condition. Playground equipment is in safe condition. The surface of the outdoor activity space is maintained in a safe condition and is free of hazards. Areas around high climbing equipment and slides have rubber matting for cushioning to absorb falls. Toilets and hand-washing equipment are in safe and sanitary operating condition. Floors in the facility are clean and safe. Solid waste storage containers have tight-fitting covers and are in good repair. Drinking water is available both indoors and outdoors. Facility has a functioning carbon monoxide detector that met statutory requirements. The last fire/disaster drill was conducted and documented 4/16/22.

A review of staff records on this date indicates facility staff or other individuals who require caregiver background checks have not received criminal record and child abuse clearances or exemptions as S1 does not have a criminal record clearance and has been working since 8/29/22; see LIC809D for deficiency cited. Director was reminded that all adults 18 and over responsible for administration or direct supervision of staff, persons who provides care and supervision to children, and staff who have contact with children, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.

Capacity and limitations as specified on the license are being maintained. At least one person trained in CPR and Pediatric First Aid is present when children are at the facility or at offsite activities. The person who signs the child in/out of the facility shall use their full legal signature and record the time of day. Children are under supervision, including visual supervision, of a teacher at all times. Facility did not maintain a ratio of one teacher supervising no more than 14 children in care as there were 31 children being supervised by two (2) staff members. LPA reviewed a sample of children’s files and observed files were complete with contact information for authorized representative and or relatives or others who can assume responsibility for the child and medical assessment. LPA reviewed a sample of staff files and observed files were complete with health screening, immunization records for influenza, pertussis and measles and current documentation of completed mandated reporter training.

This facility provides Incidental Medical Services – IMS. LPA reviewed storage of medication and equipment/supplies, and reviewed children’s, personnel, and administrative records. LPA and director discussed the Community Care Licensing website www.ccld.ca.gov which will provide access to Guardian, California Megan’s Law (www.meganslaw.ca.gov), Lead Poisoning Facts and PIN 21-21-CCP: Lead Testing of Water in Licensed Child Care Centers Per AB 2370, Forms and Regulations.

Per Title 22, Division 12, Chapter 1, of the California Code of Regulations, deficiencies were cited. See LIC809C continuation...

LPA Martha Malane informed Director, Johanna Rios that this report dated 8/31/22 documents two (2) Type A citations which shall be posted for 30 consecutive days as there is an immediate risk to the health, safety, or personal rights of children in care. Also, LPA Martha Malane informed the director to provide a copy of this licensing report dated 8/31/22 that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.

LIC 9213 Notice of Site Visit is provided and required to be posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
