Licensing Program Analyst (LPA) Jeanette Sanchez made an initial 10-Day unannounced complaint investigation visit to address the above allegation. LPA met with Director Marcia Boeche, for an interview and to discuss complaint allegation.

LPA toured the facility, took census and observed the indoor activities. During the visit, all adults were observed wearing masks however only half of children were wearing masks. At drop off, there was not any encouragement for the children to wear masks or enforcement of the parents to abide by the California Department of Public Health mask ordinance.

Based on LPAs observations and interviews which were conducted and record review(s), the preponderance of evidence standard has been met, therefore the above allegation(s) is found to be SUBSTANTIATED.

However the facility is not being cited at this time and rather a Technical Advisory will be issued.

Since LPA's visit on 8/18/21, Director has taken some steps to enforce: email to parents, changing signs, disposable masks for adults and children at the entrance, individual classroom baskets filled with individually bagged/name labeled disposable masks. In speaking with staff, there was confusion between "encouraging/enforcing and forcing" children to wear a mask.

A Technical Assistance Advisory Note (LIC 9102TA) is being issued.

The Notice of Site Visit (LIC 9213) was posted where the parent/guardian of children enter and exit the facility. The Notice of Site Visit (LIC 9213) must remain posted for 30 days during the hours of operation after each site visit by a licensing representative. Failure to maintain posting as required will result in a civil penalty of $100.00.

Exit interview conducted. A copy of this report was provided to the Director on this date.
