32 | In Room 5, LPAs observed five (5) out of fourteen (14) children who were not properly wearing their face-coverings/masks, as they were observed having their face-covering/masks pulled down underneath their chins. LPAs observed that other children in attendance were playing outside, in which no face-coverings/masks are required during outdoor playtime.
Based on LPAs observations conducted on 01/19/2022, the Licensee did not ensure the personal rights of persons in care, to safe and healthful accommodations, in that staff and children, were observed not wearing face coverings or not encouraged to wear face coverings, as required by the CA Department of Public Health Guidance on the Use of Face Coverings issued on July 28, 2021, and an individual mask exception did not apply.
Additionally, based on LPAs observations, the preponderance of evidence standard has been met, therefore the above allegation facility is not following proper COVID-19 mask guidance is found to be SUBSTANTIATED. This poses a potential risk to the health and safety of the children in care.
A Technical Assistance Advisory Note (LIC 9102TA) is being issued. LPAs provided Ms. Taupule with a copy of PIN 21-29-CCP: FACE COVERING REQUIREMENTS AND GUIDANCE FOR CHILD CARE PROVIDERS REGARDING CORONAVIRUS DISEASE 2019 (COVID-19) issued on November 23, 2021.
An exit interview was conducted, and appeal rights were discussed. A copy of this report was discussed and provided to the Administrative Assistant, Stephanie Taupule on this date.
A NOTICE OF SITE VISIT WAS ISSUED AND LPA VERIFIED THAT IT WAS POSTED IN A PROMINENT LOCATION AT THE FACILITY BEFORE LEAVING. THE LICENSEE UNDERSTANDS THAT IT MUST REMAIN POSTED FOR THE NEXT 30 DAYS. |
