Licensing Program Analysts (LPA) Nasha King and Cindy Hamilton arrived at the facility to conduct an inspection for the purpose of initiating a complaint investigation regarding the above-referenced allegation. LPAs met with the Administrative Assistant, Stephanie Taupule and informed Ms. Taupule of the purpose for the visit. LPAs conducted COVID-19 screening questions upon entering the facility with Ms. Taupule.

During this visit, LPAs toured the facility, took census, and conducted interviews with staff pertinent to the investigation. It is alleged that the facility is not following proper COVID-19 mask guidance. Upon entrance of the facility, at approximately 10:45 AM, LPAs observed two (2) staff members located in Room 2, not properly wearing their face-covering/mask (the face-covering/mask was pulled down underneath their chins) while they were talking to each other. Additionally, in Room 2, there were two (2) out of seven (7) children not wearing their masks properly, as they were observed having their face-covering/masks pulled down underneath their chins) while they were talking to each other.

In Room 5, LPAs observed five (5) out of fourteen (14) children who were not properly wearing their face-coverings/masks, as they were observed having their face-covering/masks pulled down underneath their chins. LPAs observed that other children in attendance were playing outside, in which no face-coverings/masks are required during outdoor playtime.

Based on LPAs observations conducted on 01/19/2022, the Licensee did not ensure the personal rights of persons in care, to safe and healthful accommodations, in that staff and children, were observed not wearing face coverings or not encouraged to wear face coverings, as required by the CA Department of Public Health Guidance on the Use of Face Coverings issued on July 28, 2021, and an individual mask exception did not apply.

Additionally, based on LPAs observations, the preponderance of evidence standard has been met, therefore the above allegation facility is not following proper COVID-19 mask guidance is found to be SUBSTANTIATED. This poses a potential risk to the health and safety of the children in care.



A Technical Assistance Advisory Note (LIC 9102TA) is being issued. LPAs provided Ms. Taupule with a copy of PIN 21-29-CCP: FACE COVERING REQUIREMENTS AND GUIDANCE FOR CHILD CARE PROVIDERS REGARDING CORONAVIRUS DISEASE 2019 (COVID-19) issued on November 23, 2021.

An exit interview was conducted, and appeal rights were discussed. A copy of this report was discussed and provided to the Administrative Assistant, Stephanie Taupule on this date.

A NOTICE OF SITE VISIT WAS ISSUED AND LPA VERIFIED THAT IT WAS POSTED IN A PROMINENT LOCATION AT THE FACILITY BEFORE LEAVING. THE LICENSEE UNDERSTANDS THAT IT MUST REMAIN POSTED FOR THE NEXT 30 DAYS.

Licensing Program Analysts (LPA) Nasha King and Cindy Hamilton arrived at the facility to conduct an inspection for the purpose of initiating a complaint investigation regarding the above-referenced allegation. LPAs met with the Administrative Assistant, Stephanie Taupule and informed Ms. Taupule of the purpose for the visit. LPAs conducted COVID-19 screening questions upon entering the facility with Ms. Taupule.

During this visit, LPAs toured the facility, took census, and conducted interviews with staff pertinent to the investigation. It is alleged that staff are not conducting proper daily inspection for illness on day care children. Staff interviews revealed that wellness checks are being conducted, but temperature checks are not conducted. The wellness checks are conducted visually by checking to see if the children are having any symptoms of a runny nose and/or are experiencing any coughing. If staff observes a child with any symptoms, staff will advise the Director who take the necessary steps of contacting the parent.
