Licensing Program Analyst (LPA) Vicky Williamson conducted an unannounced complaint investigation for the purpose of delivering findings in regard to the above allegation. LPA met with Director, Hope Baker. There were 12 children present with 3 staff. It was alleged that there was a lack of supervision provided by staff resulting in inappropriate behavior between children. LPA conducted interviews with the Director, staff members, several daycare children and daycare parents. Staff members denied not providing adequate supervision to daycare children resulting in inappropriate behavior between children. Staff stated that the children are supervised in the classrooms and that staff are positioned on the playground in different areas. Staff stated that they are constantly rotating around the playground to assure that supervision is maintained in all areas of the playground. Staff stated that children are escorted and supervised by staff members while utilizing the bathrooms. Staff members acknowledged that there was one incident that occurred at the facility involving inappropriate behavior between daycare children. The incidents were observed and reported by staff #1 and child #1; however staff state that adequate supervision was being provided to the children.

Staff stated that the inappropriate behavior displayed by child #1 towards child #2 was verbal and that there was no physical inappropriate interactions between the children. children. Children in question were interviewed and child #2 acknowledged that a statement was made to him by child #1. Daycare parents interviewed stated that that they feel that the inappropriate behaviors of daycare children normally come from children being curious and not a lack of supervision by staff members. Director stated that the issues were addressed by notifying the parents of the children involved in the incident, increased supervision, and review of playground supervision with staff. Based on information gathered and review of related documentation, there is no collaborating evidence to determine if there was a lack of supervision by staff resulting in inappropriate behavior between children. Due to conflicting statements obtained during the course of the investigation, the above allegation is found to be unsubstantiated meaning that although the allegation may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged violations occurred.
