LPAs Nancy Diaz and Elizabeth Rivera conducted an unannounced complaint inspection in reference to the above allegations. Observed present were 9 children with staff Josefina Syed, Alya Salem & Fahmo Gedi.
All staff and 3 children were interviewed today. Ms. Syed stated that the other qualified teacher quit in January 2019. She has conducted interviews to hire a qualified staff to replace her but has not been lucky in finding a good candidate. Staff stated that they split the children into two groups at 10:45AM. Ms. Syed goes back and forth between the two groups. Mrs. Syed also goes to lunch at around 11:45AM (for 30 minutes), leaving the children with two aides. Mrs. Syed and staff also stated that there's been days when they use the children's bathroom. Mrs. Syed stated that this happens only in the afternoon when there's only an aide and herself.
Based on LPA's interviews conducted with staff and children, the preponderance of evidence standard has been met; therefore the findings is substantiated. California Code of Regulations, Title 22, Division 12 are being cited on the attached lic 9099D.
TYPE B DEFICIENCIES ARE CITED. Type B violation if not corrected, could become a risk to the health, safety, or personal rights of children in care.

A teacher shall have completed, with passing grades, at least six postsecondary semester or equivalent quarter units of the education requirement specified in (c)(1) below, or shall have obtained a Child Development Assistance Permit issued by the California Commission on Teacher Credentialing.

Ms. Syed stated that she will hire a qualified staff by 7/22/2019. Ms. Syed will also look into hiring a substitute while in the process of hiring a permanent qualified teacher.

This regulation was not met as evidenced by LPAs review of facility staff files and interview with site director. Ms. Syed stated that children are under the supervision of aides when she goes to lunch for 30 minutes. Children are also under the supervision of aides when the class split into two groups at 10:45AM to study Arabic. Ms. Syed goes back and forth between the two groups.

Based on the total licensed capacity, one toilet and one handwashing fixture shall be maintained for every 15 children, or fraction thereof.

Immediate correction. Ms. Syed stated that this practice will stop effective today. They will continue to use the bathroom located at the mosque.

This regulation requirement was not met as evidenced by staff admission that they have used the children's bathroom in the afternoon. Staff designated bathroom is located at the mosque which is located in another building.

LPAs Nancy Diaz and Elizabeth Rivera conducted an unannounced complaint inspection in reference to the above allegations. Observed present were 9 children with staff Josefina Syed, Alya Salem & Fahmo Gedi.
Ms. Syed and staff interviewed today denied that children share blankets. Children stated that they bring their own blankets to school. Children denied seeing other children sharing blankets.
Mrs. Syed and staff denied observing bugs at the center. None of the children interviewed today has ever observed bugs at the center.
During the course of the investigation, LPA conducted interviews with director, facility staff and children. Based on the information gathered, it could not be conclusively determined whether children shared blankets and sheets or if the bugs found in the child's backpack were from the daycare. LPA is unable to determine whether or not the allegations actually occurred, therefore the preponderance of evidence standard has not been met. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore LPA found the complaint allegations to be UNSUBSTANTIATED. No deficiency cited.
