On 09/15/2021 at 10:25AM, Licensing Program Analyst (LPA), Samantha Clenista conducted an unannounced complaint inspection to address the above allegation. LPA conducted a tour of the facility upon arrival and observed 84 children with 9 staff. All staff were observed to be wearing their masks, however, all children were unmasked (both indoor and outdoor) with the exception of two children. LPA also observed several parents/guardian entering and leaving the facility unmasked. Based on information obtained, LPA's observation during inspection and interview with director, it was determined that the school has not been following the mandate of having all individuals who are 2+ years old wear a mask indoors (regardless of vaccination status) which is a requirement per County of San Diego and California Department of Public Health. This complaint allegation is determined to be Substantiated as the preponderance of evidence standard has been met. Type A deficiency under California Code of Regulations, Title 22, Division 12 & Chapter 1, is being cited on the attached LIC 9099D. Appeal Rights were discussed and provided. Signature at the bottom of this report confirms receipt. Notice of Site Visit was posted and will remain posted for 30 days.

Director stated a newsletter regarding the mask mandate and an update regarding COVID-19 center policy will be created and sent to all day care parents by 09/17/2021. Director stated that all staff will also be provided the same updates and will encourage children to wear a mask moving forward.

based on LPA's observation during inspection and conducted interviews, it has been determined that the facility has not enforcing the use of mask indoors for children and parents in care. This poses a immediate health and safety risk to clients in care.

Director also stated that she purchased an order to receive extra children's mask. Director stated she will provide LPA with a copy of the newsletter and updated policy no later than 09/20/201. A POC visit will be conducted on a later date.
