Licensing Program Analyst (LPA) Edgar Campana conducted an unannounced visit on 09/24/2021 to conclude complaint investigation. LPA met with Director, Luis Sanchez, to discuss above allegations. LPA toured the facility and noted that there were no children in care at the time. Two (2) staff members were also present. This agency has investigated the above listed allegations. Throughout the course of the investigation, LPA toured facility, reviewed records, and conducted interviews with daycare parents, San Diego Rescue Mission employees, a pest control technician and facility staff.

Regarding the allegation that outdoor activity space is not maintained in a safe condition for children's use, LPA conducted in-person inspections of the activity space, interviewed staff, and reviewed service records. During LPA’s inspection of activity space, nothing was observed to be immediately dangerous or unsafe for daycare children use. During interviews with staff members, possible improvements to outdoor activity space were mentioned (e.g. shade for play structure, different fencing); however, no staff indicated having safety concerns or reservations about daycare children using the outdoor activity space. LPA also reviewed maintenance service records for outdoor activity space service requests. Records reviewed indicate that service requests made by the daycare center were addressed in a timely manner.

Regarding the allegation that the center does not have a current disaster and mass casualty plan of action, LPA observed an Emergency Disaster Plan for Child Care Centers (LIC 610) visibly posted at the facility during a visit conducted on 08/19/2021. Although one staff member listed on the form was no longer employed at time of visit, center was closed at the time and a new LIC 610 has been submitted to the Department.

Regarding the allegation that the center did not have qualified staff, LPA reviewed staff records and interviewed staff members. During record review, staff members employed prior to facility closing for summer break were determined to be fully qualified teachers. During staff interviews, no staff members indicated that other unqualified staff members had been employed by the facility in the weeks prior to the facility going on summer break. However, there was a change in center director during the summer break, with a new center director being hired on 08/23/2021. The previous center director resigned effective 07/30/2021, leaving the center without an official director for almost thirty days.

Regarding the allegation that staff is not able to ensure the safety and well-being of children at all times, LPA toured facility and interviewed staff members and day care parents. During tours of facility, LPA observed that keycards are required in order to access the first floor via elevators, where the day care center is located. LPA further observed that day care center area of facility is delineated solely by use of a rolling sign, which makes it accessible to anybody with keycard access. During interviews with staff members, all staff members stated that children are supervised at all times. All staff members further stated that any non-staff members who enter day care center area are asked to leave immediately. During interviews with day care parents, one out of three day care parents expressed concern with facility supervision of day care children

Regarding the allegation that the center is in disrepair, LPA toured the facility, interviewed staff, and reviewed service records. During LPA tours of the facility, minor wear and tear was observed at the facility; however, conditions of facility disrepair which pose a threat to the health and safety of children in care were not observed. During staff interviews, one out of two staff members indicated that service requests for day care center classroom repairs had been submitted to the maintenance department. During reviews of maintenance service records, service requests for the day care center classrooms were resolved in a reasonable amount of time.

Regarding the allegation that the center has pests, LPA toured facility, interviewed staff, day care parents, a pest control technician, and also reviewed service records. During tours of facility, LPA did not observe any pest infestations in day care areas. During interviews with staff, no staff members indicated any concern for pests or vermin in day care areas. During interviews with day care parents, no day care parents stated concern for pest or vermin in day care center. During interview with pest control technician, treatment schedule was discussed. Pest control technician stated that although the first floor of facility (where day care center is located) receives monthly treatments, these treatments are preventative in nature and technician has not observed any pest infestations close to day care center rooms.

Regarding the allegation that center does not provide appropriate meals to children in care, LPA reviewed menus and conducted interviews with day care staff, kitchen staff, and day care parents. LPA reviewed menus for day care center and determined that food being served is of the quality and in the quantity necessary to meet the needs of the children. During interviews with staff members, 2 staff members stated that expired milk had been delivered to day care center by kitchen in the past; expired milk was detected and returned to kitchen, however. During interviews with kitchen staff, menus were discussed, and nutrition standards were explained to LPA, specifically that facility is working with San Diego County on a nutrition program for day care center. During interviews with day care parents, one out of three parents expressed concern over the amount of food being served to day care children and stated that her child had complained about being hungry on some occasions.

Regarding the allegation that foods served to children are not prepared in a safe and healthful manner, LPA toured kitchen of facility and interviewed day care staff members and kitchen staff members. During tour of kitchen area, LPA observed that day care food was properly stored in either freezers or refrigerators. LPA also observed food trays covered with plastic wrap prior to being transported to day care center. During interviews with day care staff, no staff members indicated any knowledge of food preparation procedures, as they are not present in the kitchen at the time food is prepared. During interviews with kitchen staff, food handling procedures were discussed. Kitchen staff indicated that they always wear masks and gloves while preparing food. Additionally, the food service manager for the facility stated that all kitchen staff possess food handler’s cards.

Based on interviews conducted, LPA observations, and records reviewed, there is a lack of evidence available to be able to draw definitive conclusions. Although the above allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore it is determined that the above allegations are UNSUBSTANTIATED.

An exit interview was conducted with the Director and a copy of this report, appeal rights (LIC 9058), and LIC 9213 – Notice of Site Visit was provided. Director was advised to post the LIC 9213 for 30 days.
