At 11:34 am on 06/04/2020, Licensing Program Analyst (LPA) Selina Siao, contacted the facility to deliver the above complaint finding. Due to COVID-19, a tele-inspection was conducted using Face Time to tour the facility. The initial inspection was conducted by LPA Siao on 04/08/20. Throughout the course of investigation, interviews were conducted with the reporting party, several employees and several parents. Facility's records were obtained including the facility's roster. Based on information obtained and interviews conducted, the preponderance of evidence standard has been met that an unqualify staff #1 has been left alone on a regular basis to provide care and supervision in the Baby Bear classroom after COVID-19. The above allegation is found to be SUBSTANTIATED, California Code of Regulations, Title 22, Division 12 & Chapter 1 101416.2(b) is being cited on the attached LIC 9099D.
Appeal Rights (1/16) were discussed and provided. Facility was advised to post the Notice of Site Visit and failure to keep the posting will result in $100 civil penalty. Analyst read the report to Administrator during the tele-inspection. A copy of the report will be e-mailed to the Administrator and was advised that acknowledgement of the receipt of the report is to be received within twenty-four hours.

Infant Care Teacher Qualifications and Duties
Prior to employment, an infant care teacher shall have completed, with passing grades, at least three postsecondary semesters or equivalent quarter units in early childhood education or child development, and three postsecondary semester or equivalent quarter units related to the care of infants, at an accredited or approved college or university.

Administrator stated that in the future she will be sure that a teacher aide is not alone in the classroom. She will provide training with staff members and will submit the agenda along with staff's sign in sheet to Licensing by 06/10/2020.

This requirement is not met as evidence that staff# 1 has not completed any Child Development courses. This poses a potential Health and Safety risk to the clients in care.

At 11:34am on 06/04/2020, Licensing Program Analyst (LPA) Selina Siao, contacted the facility to deliver the above complaint findings. Due to COVID-19, a tele-inspection was conducted using Face Time to tour the facility. The initial inspection was conducted on 04/08/20. Throughout the course of investigation, interviews were conducted with the reporting party, several staff members and several parents. Staff members denied leaving milk out for a long period of time. Staff members stated that they wear gloves and uses wipes or tissues to clean the children's face and nose throughout the day. Staff members also stated that the room gets clean and sanitize at least three times a day and when there is a down time. Based on the inconsistent and contradictory information obtained during the investigation, the allegations are considered to be Unsubstantiated and no deficiencies are cited.
Appeal Rights (1/16) were discussed and provided. Facility was advised to post the Notice of Site Visit and failure to keep the posting will result in $100 civil penalty. Analyst read the report to Adminstrator during the tele-inspection. A copy of the report will be e-mailed to the Administratot and was advised that acknowledgement of the receipt of the report is to be received within twenty-four hours.
