13 | At 1:10pm on 06/08/2020, Licensing Program Analyst (LPA) Selina Siao, contacted the facility to deliver the above complaint finding. Due to COVID-19, a tele-inspection was conducted using Face Time to tour the facility. The initial inspection was conducted on 04/08/20. Throughout the course of investigation, interviews were conducted with the reporting party, several employees and several parents. Records were obtained and reviewed related to the above allegation. Administrator Pooja Sharma stated that a 20 months old toddler from the Tigers class was placed with in the infant classroom after COVID-19 pandemic, as she thought all children under 24 months can be together due to the County's Health Orders. Administrator stated that she had obtained written consent from the parent. Based on documents obtained and interviews conducted, the preponderance of evidence standard has been met that facility placed a toddler into the infant class without written consent from the parent. The above allegation is found to be SUBSTANTIATED, Health and Safety Code, 1596.956(a)(6) is being cited on the attached LIC 9099D.
Appeal Rights (1/16) were discussed and provided. Facility was advised to post the Notice of Site Visit and failure to keep the posting will result in $100 civil penalty. Analyst read the report to facility representative during the tele-inspection. A copy of the report will be e-mailed to the facility and was advised that acknowledgement of the receipt of the report is to be received within twenty-four hours.
