Licensing Program Analyst (LPA) Williamson conducted an unannounced inspection for the purpose of delivering complaint finding in regard to the above allegations. LPA met with Lead Teacher, Maressa Smallwood. There was a total of 9 infants present with 4 staff members. It was alleged that staff has inappropriate reactions in front of children, staff are restraining a daycare child and staff leave children alone with an aide. Interviews were conducted with the director, facility staff and several daycare parents. Children were unable to be interviewed due to being non-verbal. Staff in question denied having inappropriate reactions in front of children. A total of 7 staff members were interviewed and a few staff members stated that staff #1 has been observed having inappropriate reactions in front of children; however, there is no collaborating evidence that provides proof that the incidents occurred. Other facility staff denied ever observing staff #1 having inappropriate reactions in front of daycare children. Information received indicated that staff are swaddling daycare children. Facility staff denied restraining any daycare children. Director Amanda Lundy stated that she and the staff were informed during an inspection by the Licensing Agency on 11/29/18 that swaddling is not allowed per Title 22 Regulations.

Director states she ensures that the staff adhere to the safe sleep practices. Information received indicated that staff are leaving daycare children alone in the classroom with an aide. A total of 4 out of 7 staff interviewed denied leaving day children alone in the classroom with an aide. Other staff members indicated that on occasion staff members have left an aide in the classroom alone; however due to conflicting information received there is no collaborating evidence to provide proof that an aide was left in the classroom alone with out assistance from a qualified staff. Due to conflicting statements obtained during the course of the investigation from staff and daycare parents, the above allegations are found to be unsubstantiated meaning that although the allegations may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged violations occurred.
