On September 20, 2021 at 12:35 PM, Licensing Program Analyst (LPA), Marie Hernandez conducted an unannounced complaint investigation inspection to deliver the complaint findings for the above allegation. LPA met with the Facility Director, Amanda Lundy. Present are fifteen children with four staff.

Through the course of the complaint investigation, LPA conducted several confidential interviews with the Facility Representatives, six staff, two witnesses, twenty two day-care parents, including former day care parents, law enforcement, other agencies, and the Reporting Party. The children could not be interviewed as they are infants and non-verbal. During the initial complaint investigation on 06/15/2021, LPA conducted an inspection of the facility including the napping equipment (cots). LPA did not observe anything inappropriate with the cots at time of inspection. LPA reviewed and obtained pertinent information. The Department received a complaint alleging that child #1 was inappropriately disciplined and sustained several abrasions on the forehead, chin and bruising on the left shoulder. However, it was determined that child #1’s injuries to the forehead and chin were patterned lesions consistent with the pattern of the napping cot material.

However, it was undetermined how child #1 sustained the bruising to his left shoulder due to conflicting information provided. It is unclear whether the teacher #1 inappropriately disciplined or restrained child #1. The teacher #1 denied the allegation and stated she did not inappropriately discipline or restrain child #1. The Facility Representatives and the staff denied the allegation and stated no child was inappropriately disciplined or restrained. The interviews revealed that child #1 was thrashing himself on the cot, flailing his arms and having a tantrum as child did not want to nap. The witnesses stated child #1 was not restrained or inappropriately disciplined. The day care parents stated they did not have any concerns or issues with the staff or the facility.

Based on the interviews and information obtained, there was conflicting evidence to corroborate the allegation that “Provider inappropriately disciplined day care child”, therefore the allegation is found to be UNSUBSTANTIATED meaning that although the allegation may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged violation occurred.

LPA Marie Hernandez explained the complaint investigation report and the appeal rights to the Facility Director, Amanda Lundy. The Director was provided a copy of the report, Notice of Site Visit, and the appeal rights. LPA observed the notice of site visit being posted at the facility.
