On the above date and time listed, Licensing Program Analyst (LPA) Keely Messerschmidt arrived at the facility for the purpose of intitating a 10 day complaint visit on the above-referenced allegations. LPA met with Director Patty Lopez and Owner Sally Chenoweth. LPA toured the facility, conducted census, and verified facility staff and children enrollment. LPA discussed with Owner the conclusion of the complaint investigation.

On January 22nd, 2024, Community Care Licensing (CCL) received a complaint alleging that staff do not provide adequate supervision and that staff placed a child in a highchair due to being fussy. In regard to the allegation, staff do not provide adequate supervision, LPA Messerschmidt conducted pertinent interviews with the Director, staff and other parties involved and was able to corroborate this allegation. Based on interviews, it was revealed that staff do not typically stay in the nap room with the sleeping babies but will stand in a position where they can see the babies through the window. During the inspection on 1/25/24, LPA observed the infant room unsupervised.

It was disclosed that staff typically check on the sleeping babies when they complete the 15 minute sleep checks and that there are times where a staff member will stay in the nap room but will step out as needed. In regard to the allegation, that staff placed child in highchair due to being fussy, LPA Messerschmidt conducted pertinent interviews with staff and other parties involved and was able to corroborate this allegation. Based on interviews is was disclosed that when a baby gets extra fussy and the staff are busy they will place the child in the highchair with a teether to calm them down.

Based on the information obtained during this investigation, it has been determined that although the allegations may have happened or is valid, there is enough evidence to prove that the alleged violations did occur. Therefore, the allegations are SUBSTANTIATED.

An exit interview was conducted, and this report was reviewed with the Owner, Sally Chenoweth, and a copy was provided. Appeal rights were discussed and provided during the exit interview.

A Notice of Site visit was given, Owner and Director understands that it must remain posted for 30 days.
