Licensing Program Analyst (LPA) Jennifer Lott conducted a complaint investigation visit regarding the above-mentioned allegation. LPA was greeted at the front door by Michelle Berkowitz and granted entry after identifying herself and disclosing the reason for her visit. Director, Cathy Goldberg arrived a short time later. During today’s visit, LPA Lott toured the facility, reviewed facility records and interviewed staff.

It is alleged that a day care child (C1) wandered away from a classroom unattended. On or about 07/06/2022, parents were picking up their children from the infant classroom. Based on interviews conducted with staff, a parent did not lock the gate to the classroom after picking up their child. Multiple staff admitted to not noticing that the gate was unlocked. C1 was able to open the gate and wander down the hallway past 2 classrooms unnoticed. A parent picking up their child found C1 unattended in the hall and returned them to the appropriate classroom.

This department has investigated the allegation, day care child wandered away from classroom unattended. Based on LPA’s review of facility records, and interviews with staff and parents, as well as the inspection of the facility, the preponderance of evidence standard has been met, therefore the above allegations are found to be SUBSTANTIATED. Deficiencies are cited per California Code of Regulations, Title 22, Division 6 on the attached 9099D.

LPA Lott informed Director, Goldberg that this report dated July 8, 2022 documents -1 Type A citation which shall be posted for 30 consecutive days as there is an immediate risk to the health & safety of children in care.

Also, LPA Lott informed the Director, Goldberg to provide a copy of this licensing report dated July 8, 2022, that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.

An exit interview was conducted and report was reviewed with Director, Goldberg. A notice of site visit was given, and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
