25 | On January 4th, 2023 at 10:05 AM, Licensing Program Analyst (LPA) JoAnn Legaspi conducted an unannounced, case management inspection for the Action Level Exceedance (ALE) of lead detected in a facility water fixture. LPA met with Director Yolanda Alvarez. The purpose of the inspection was explained, and facility was toured. Present in facility were eighty-three (83) children with ten (10) staff.
LPA discussed the new Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018, which requires the testing of water for lead in Child Care Centers (CCCs) with facility director during the inspection. Per AB 2370, all CCCs that are located in buildings constructed before January 1, 2010, must have their water tested and post the results by January 1, 2023, and every 5 years after the date of the first testing.
The Department obtained copies of the External Water Sampler Self-Certification Form (LIC9275), Child Care Center Sampling Checklist (LIC9276), Facility Sketch (LIC999), on 12/20/2022.
On 12/16/2022, the Department received notification from the State Water Resources Control Board (SWRCB), Division of Drinking Water (DDW). The SWRCB report (testing #1406) indicated the facility was inspected and samples were collected on 12/08/2022. The outlets/fixtures reported with 5.5 ppb or greater lead exceedance levels were as follows:
B – Drinking Playground Fountain. Fountain has been removed from service for about 2.5 years.
Director Alvarez reported the playground drinking fountain is off-limits for children. Director Alvarez stated the fountain has not been utilized for drinking water or food preparation for about 2.5 years. The director stated all staff have been made aware of the ALE in the drinking fountain and will not utilize the fountain for drinking water or food prep. An ‘out of service’ sign is on the fountain and the water has been turned off. |
