Licensing Program Analyst (LPA) Jo Ann Legaspi conducted a site visit to conclude the investigation the above allegations. LPA advised Director Michaelyn Rainney of the meeting’s purpose and was granted facility entry. The investigation involved several facility visits, observations, interviews and record reviews.

It was alleged that staff were aggressive with children, specifically staff grabbed and pushed children. Staff and two (2) prior substitute teachers denied themselves ever utilizing adverse physical action towards children. They also denied observing any other staff engage in aggressive physical behaviors towards children. Parents of current and prior day-care children denied observing staff display physically aggressive behaviors towards children. They also denied observing suspicious marks upon their children or their children displaying changed behaviors. Each classroom has a window, which visitors may observe interactions between staff and children without detection. LPA has conducted frequent unannounced facility visits. During these visits, LPA observed interactions between staff and children to be appropriate and without any physical forcefulness. Day-care infants are non-verbal but were observed with no visible injuries.

It was alleged staff use inappropriate hygiene practices, specifically staff do not wash their hands after diaper changes. Furthermore, toys are not sanitized, and a single wipe is used to clean multiple children. Staff and two (2) prior substitute teachers assert toys were regularly cleaned and sanitized. Staff and the two (2) prior substitute teachers also state staff wear gloves during diaper changes and wash their hands after each change. A parent of a prior day-care child stated about six (6) months ago, they observed an unknown staff member conduct consecutive diaper changes while wearing the same gloves and not wash their hands between diaper changes. Staff denied single wipes are used on multiple children.

Although the allegations may have happened or is valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegations are unsubstantiated.

A Notice of Site Visit (LIC 9213) was provided to staff. This notice is to be posted for thirty (30) days. An exit interview was conducted with Director Rainney. Appeal Rights (LIC 9098 01/16) along with a copy of this report was provided to Director Rainney and their signature on this form confirms receipt of these rights.
