25 | On 08/13/2024 at 1:00 pm, Licensing Program Analyst (LPA), Daniela Huerta conducted an unannounced case management inspection to follow-up on a self-reported unusual incident reported to the Department. Upon arrival, LPA met with Assistant Director, Shannon Hontz and disclosed the purpose of the inspection and was led on a tour of the facility. At 1:15pm, Chief Operating Officer (COO) Ebony James arrived and LPA disclosed the purpose of the inspection with her. There were 32 children present, and 6 staff members present.
The Department received an unusual incident report on 08/06/2024, in which an unusual incident occurred on 08/05/2024 when staff member (S1) assaulted another staff member (S2) and as a result law enforcement officers were called. It was reported that on 08/05/2024 at approximately 8:40am, S1 was laid off and shortly after his dismissal from the facility, S1 attempted to enter the preschool to obtain his belongings, however, S2 stopped him by pulling on S1's arm to stop him from entering the preschool and as a result S1 responded by elbowing S2 on his head. During the altercation S2 pushes S1 into S3 and S3 and S2 tackled S1 down onto the ground. Both S2 and S3 restrained S1 on the ground. Assistant director called law enforcement, police officers arrived on scene.
LPA inspected the lobby area as well as the classrooms where the children were present during the incident and found the area to be separate from the classrooms. COO Ebony James refused LPA Huerta to interview the daycare children stating she does not want the children to possibly be re-traumatized. LPA was unable to interview children. Per Title 22, Division 12, Chapter 1, of the California Code of Regulations one (1) deficiency is being cited. See the attached LIC 809-D.
