On October 20, 2023, at approximately 9 am, Licensing Program Analysts (LPAs) Man Tso and Catrina Quimbo conducted an unannounced, annual inspection. LPAs met with a teaching staff (TA #2) and explained the purpose of the inspection. Present during LPA's visit included 41 children (all preschool age) and 9 staff members. During LPAs’ visit, Director, Kathy Tuwai met LPAs at approximately 9.40am. The Director toured LPAs’ visit. Facility is operating within capacity limits and ratio during LPAs’ visit.

The facility was inspected, indoors and outdoors, for health and safety hazards. Hours of operation are Monday to Friday 7:45am to 5:30pm.

LPA observed classroom to be clean, equipped with age-appropriate materials, toys and furniture. Classroom is appropriately ventilated with proper temperature. LPA observed all poisons, cleaning solutions and hazardous materials to be stored inaccessible to children on facility's high shelves. Storage for children's belongings is located inside the classroom that are labeled with each child's individual names. Facility is equipped with multiple fully charged fire extinguishers, fully stocked first aid kit and carbon monoxide detectors. Facility is also equipped with a fire alarm system implemented.

Facility provides a breakfast, lunch afternoon snack to enrolled children. Water outlets with filters is made available to children indoors and outdoors with children's water bottles that are refilled at facility.

LPAs observed children's bathrooms to be clean equipped with toilets and sinks. Bathrooms were observed to be clean and in proper working condition. However, in classroom Sunshine, LPAs observed a bottle of cleaning spray put on a cabinet that perceived not high enough to be accessed by the children. LPAs reminded the Director to move to a higher position or put into a cabinet and locked. (Please refer to Technical Violation issued).

Children are signed in and out of facility by front entrance. But it was signed in/out by staff, instead of parents. (Please refer to LIC809D issued). Facility has license documentation and information properly posted and available for review in main entrance of facility.

LPAs reviewed facility records that included 5 children's records and 5 staff members' records. LPAs observed children's to be complete with identification and emergency information on file, except C#4 that the LIC627 had not signed by the parent. (Please refer to Technical Violation issued) Teachers' files were also complete. But the Mandated Reporter Training certificate of 2 TA (TA # 2 & #3) expired on 9/27/23 and not found on the file respectively. Multiple staff members on site have a valid CPR certificate that is current and will expire in 2024 or 2025. The last emergency drill was conducted 08/29/2023. Emergency drills are conducted at least once every six months and are properly documented.

LPAs discussed the safe sleep regulations with the Director and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed the Director of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

LPA reminded the Director that as of September 1, 2016. A person may not be employed or volunteer at a childcare facility unless he or she has been immunized against influenza, pertussis, and measles.

The Director was informed about Mandated Reporter training available on the CCLD website. In addition to AB1207 training required to be completed every two years by all staff hired a one-time General Training is also required. Training can be taken online at www.mandaterreporterca.com. The Director was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California.

To improve the quality and value of the new inspection process, a survey will be sent to the email address provided. Please complete the survey and share your inspection experience. Incidental Medical Services (IMS) policy was discussed. For IMS information see PIN 22-02-CCP. When any IMS is provided, an updated Plan of Operation that includes IMS must be submitted to the Department. The Director was reminded that all adults 18 and over, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated.

Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018, requires all licensed Child Care Centers (CCCs) constructed before January 1, 2010, to test their water (used for drinking and food preparation) for lead contamination before January 1, 2023, and then every 5 years after the date of the first test.
LPA verified that the lead testing was completed in accordance to the Written Directives outlined in PIN 21-21.1-CCP. The water fixture tested for lead exceed 5.5 ppb threshold, which poses/posed a potential health, safety or personal rights risk to persons in care. (Please refer to LIC809D).

2 Type B deficiencies were issued under CCR, Title 22, Division 12. Rights of Appeal was provided to the Director.
A notice of site visit was given and must remain posted for 30 days.
