On October 10, 2023, Licensing Program Analyst (LPA) Van met with Director Mindy Louie for an unannounced annual random inspection. The purpose of the inspection was explained and granted entry to the facility by the Director. The Center is a preschool program that operates in two large classrooms on the street level. There is another large room below the street level that the children pass by to access the outdoor space. The Director confirmed that the mentioned room is used for storage and not for childcare. Present today are 8 children supervised by three staff. The facility complies with the staff-children ratios today. All staff members have criminal clearance on file. The days and operations hours are Monday - Friday from 7:30 a.m. to 6:00 p.m.

During the inspection, the Director and LPA thoroughly examined the physical facility to identify any potential health and safety hazards. The facility has a manual sign-in/out record system, and upon review, it showed that all parents' signatures matched and accounted for the number of children present. The facility is in good condition, and the temperature and ventilation levels are properly maintained. Age-appropriate toys and educational materials are available in each classroom. The furniture is sturdy and well-maintained. LPA observed that each child has their own cubby available with their name labeled. The facility is equipped with multiple combinations of carbon monoxide and smoke detectors, fully charged fire extinguishers, and functioning telephones. LPA noticed that emergency supplies are securely stored, and first aid supplies are fully stocked and readily accessible to children. All hazardous materials, including cleaning solutions and poisons, are kept out of the reach of children. Additionally, sleeping cots are appropriately stored. Per the Director, parents provide blankets and pillows that are washed weekly.

Based on observation, interview, and record review, the licensee did not comply with the above-referenced section. Water fixtures were tested for lead after the due date of January 1, 2023, which poses a potential health, safety, or personal rights risk to persons in care.

In February 2023, the facility conducted lead water testing, and the results indicated that water fixtures were below the 5.5 ppb threshold. The Director has confirmed that she will provide a complete copy of the report to LPA by October 13 to clear the POC.

The Director states that the Center currently does not have any children who require medication. However, in cases where medication is required, it is stored on a high shelf that is inaccessible to children. The toilets and handwashing sinks are in good working condition and regularly sanitized. Lastly, LPA observed no bodies of water on the premises.

The facility has been granted an outdoor waiver by the Department to allow a maximum of eight children to utilize the playground at any given time. LPA observed that the outdoor waiver was posted accordingly. The outdoor play area is well maintained, ensuring it is clean and free of any clutter that may pose a risk to the children's safety. Moreover, the playground is securely fenced. Per the Director, the play structures are regularly checked for any potential damage or loose parts. Additionally, soft cushioning material is placed beneath the play structures to minimize the chances of injuries from accidental falls. LPA also reminded the Director to check and clear any debris or harmful materials from the playground before use in accordance with the regulations.

During the inspection, LPA reviewed records pertaining to children and personnel. The records for each child were found to be complete, including their names, addresses, and authorized representative telephone numbers. Additionally, each child's file contains information about their immunization record, medical assessment, and admission agreement. Staff members' records showed that all individuals requiring caregiver background checks had undergone criminal records and child abuse index clearances or exemptions. The director possesses valid CPR certificates, and staff maintain up-to-date immunization records. LPA reviewed the educational qualifications of the staff members and confirmed that everyone had completed the required ECE units. Fire and earthquake drills are conducted at least once every six months.

The facility had posted the required forms. (i.e., License, waivers, Notification of Parent's Rights, Notification of Personal Rights, Car Seat Law, Emergency Disaster Plan, and Daily activities). Per the Director, the Center provides breakfast, lunch, and two snacks for children prepared at the Center. The snack menu is observed posted. The food preparation area is adequately equipped, clean, free of hazards, and inaccessible to children. Per the Director, the children can bring their water bottles from home, or the facility also has water bottles readily available for children indoors and outdoors. All storage containers for solid waste within the Center have a proper tight-fitting cover.

The Director was reminded that all adults 18 and over, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated.

Incidental Medical Services (IMS) policy was discussed. For IMS information, see Evaluator Manual - Regulation Interpretations and Procedures for Child Care Centers Sections 101173 and 101226. When any IMS is provided, an updated Plan of Operation that includes IMS must be submitted to the Department. The Director was informed about Mandated Reporter training AB 1207. The Mandated Reporter AB 1207 training must be completed every two years by the Licensee and for all staff hired. The Director was informed of the MyChildCarePlan.org website, a consumer education website that helps families obtain child care by connecting them to childcare providers and Resource and Referral Agencies (R&Rs) throughout California.

Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018, requires all licensed Child Care Centers (CCCs) constructed before January 1, 2010, to test their water (used for drinking and food preparation) for lead contamination before January 1, 2023, and then every 5-years after the date of the first test.

For child care center licenses issued after July 1, 2022, the licensee shall test their water for lead within 180 days of licensure pursuant to Written Directives section 101700 (PIN 21-21.1- CCP).

CHILD CARE CENTER DID NOT COMPLETE TESTING PRIOR TO THEIR DEADLINE
LPA referred the Director to the Department website for lead: Lead Toxicity Prevention and Water Testing Information.

During the inspection, LPA requested the following updated document be sent to the Licensing office by October 23, 2023, to complete the annual inspection.
  • An up-to-date Emergency Disaster Plan (LIC 610)
  • Personnel Report (LIC 500)
  • Designation of Administrative Responsibility (LIC 308)
  • Basic Pest Management Training & Mandated Training completion for all staff
  • Updated immunization record for the Director
