On May 11, 2022, Licensing Program Analyst (LPA) Van conducted an annual 1-year mandated inspection, including inspecting the facility's interior and exterior and reviewing the required childcare paperwork with the Licensee. LPA met Gelma Gate and explained the purpose of the inspection. The Licensee, the Licensee's helper, and 9 enrolled preschool children are present at home. Every adult living or working in the house has a criminal record clearance. Daycare areas are on the main level, including the living room, dining room, kitchen, bathroom, and the front portion of the backyard. During the inspection, the Licensee wishes to make the Living room an off-limit area. The new Off-limit areas are the entire top level, the ground level, the back portion of the backyard, and the newly requested living room. All restricted daycare areas have been appropriately blocked off from the children. According to the Licensee, when a child displays indications of illness, the Licensee will separate and have the child wait in the front section of the play yard while contacting the parent to take them up. The days and hours of operation are Monday through Friday, 8:30 am to 4:30 pm.
LPA toured and evaluated the indoor and outdoor play areas for health and safety hazards. The childcare space is clean and tidy, with age-appropriate activities, books, and play materials. Mats are for older children to use for napping, and the parents provide mats. LPA discussed with the Licensee the new Safe Sleep Regulation and informed the Licensee that no toys or pillows are allowed in the infants' crib or playpens, and all cribs/playpens should have mattresses that are the exact size and have fitted sheets. The home has sufficient heating, lighting, and ventilation, and it is free of defects or risks that harm children in care. There are a fully charged fire extinguisher, smoke and carbon monoxide detectors, as well as a functional phone. Fully stocked first aid supplies are available for children.

Poisons, detergents, and cleaning agents are kept in a secured cabinet beneath the kitchen sink, with child-proof installed. According to the Licensee, there are no firearms or weapons. The Licensee has a dog at home, and according to the Licensee, the dog has up-to-date vaccination. There are no pools, spas, or other bodies of water on the premises. LPA observed no baby walker, baby bouncer, or similar equipment in the daycare areas. Licensee acknowledges that smoking is prohibited in family childcare homes. According to the Licensee, the facility serves breakfast, lunch, and morning and afternoon snacks.
Per Licensee, she has not conducted any fire and earthquake drills since July 2021. The Licensee could not provide any documentation of any previous drills conducted.
The facility has records for children in care, including immunization records. Each child has a complete emergency information card with the child's full name, telephone number, and location of a parent or authorized representative to be contacted in an emergency. The name and telephone number of the child's physician and the parent's authorization for the Licensee to consent to emergency medical care are on their respective file. The facility has posted all the required forms, such as facility License, Notification of Parent's Rights, and Notification of Personal Rights. Licensee and helper kept a record of their immunizations. However, both Licensee Mandated Reporter Training AB1207 were expired. In addition, both Licensee and Helper Pediatric FirstAid CPR were expired, Technical Violation was issued. Licensee stated she and helper have already signed up for the CPR class, the class will take place next week.
LPA discussed the safe sleep regulations with the Licensees and discussed the Child Care Licensing Safe Sleep webpage https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed the Licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.
The Licensee was reminded about the Provider Information Notices (PINs) on the CCLD website. Licensees were informed that as of September 1, 2016, a person may not be employed or volunteer at a child care facility unless he or she has been immunized against influenza, pertussis, and measles or qualifies for an exemption pursuant to Health and Safety code 1596.7995 and 1597.662. LPA reviewed AB 1207 with the Licensees. As of January 1, 2018, all staff must complete Mandated Reporter Training every two years. The training can be obtained online at www.mandatedreporterca.com. Effective July 1, 2020, Licensees must have proof of completion of EMSA certified lead poison training if applying for a change of location or capacity change to an existing license.
LPA encouraged the Licensee to visit the Licensing website at www.ccld.ca.gov for licensing regulations and new updates. The Licensee can also email at childcareadvocatesprogram@dss.ca.gov and ask to be added to the email list for the updates.

This report and rights to comment and appeal have been discussed with the Licensee. The report was reviewed and signed by Licensee Gelma Gate. Today's report, 5/11/2022, and site visit notice will be sent to Gelma Gate's email on 5/11/2022. Confirmation of receipt is required, and a site visit notice must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.

Safety precautions shall include but not limited to: (9) Each family child care home shall have a written disaster plan of action prepared on a form approved by the Department. Based on record review and interview, the Licensee could not provide a record of the fire & earthquake drills. The Licensee stated the last drills were conducted sometime in July 2021 but could not provide documentation. Not conducting fire and earthquake drills poses/posed a potential health, safety, or personal rights risk to persons in care.

(1) On or before March 30, 2018, a person who, on January 1, 2018, is a licensed child day care provider, administrator, or employee of a licensed child day care facility shall complete the mandated reporter training provided pursuant to paragraphs (2) and (3) of subdivision (a), and shall complete renewal mandated reporter training every two years following the date on which he or she completed the initial mandated reporter training.

The Licensee could not provide any record of completion available for review, which poses/posed a potential health, safety or personal rights risk to persons in care.
