Licensing Program Analysts (LPAs) Chayntel Hunter and Christopher Jackson and met with Director, Rachael Kulling to deliver the findings of the complaint investigation regarding the above allegations.

During the course of the investigation, LPAs Hunter and Jackson conducted interviews, and obtained information pertaining to allegations. It was alleged that staff are handling children in a rough manner. Interviews conducted revealed that staff are grabbing children by the wrist and arm, and picking them up in a rough manner, as a form of discipline. It was also alleged that the classroom is operating out of ratio. Interviews conducted revealed that during nap time some classrooms combine their children to accommodate ratios, but after nap time staff are still left alone with approximately 13-18 children after the children have woken up, and transition into the gym area, which is when the facility goes back into ratio.

Licensing Program Analysts (LPAs) Chayntel Hunter and Christopher Jackson and met with Director, Rachael Kulling to deliver the findings of the complaint investigation regarding the above allegations.

During the course of the investigation, LPAs Hunter and Jackson conducted interviews, and obtained information pertaining to allegations. It was alleged that a two year old child was lost on the campus. Interviews conducted provided inconsistent information as to whether the child was actually missing, and where staff were located during the incident. LPA was unable to determine if the child was left unattended, or if staff were present. It was also alleged that teacher aides are being left alone with the children, at times other than those outlined in Title 22 regulations. LPAs were unable to determine if aides were left alone with children, other than at nap time.

Based on the information obtained throughout the course of this investigation the above allegations could not be substantiated or dismissed. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the finding is UNSUBSTANTIATED.

Exit interview was conducted. A notice of site visit was provided and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.

Lastly it was alleged that children are not fed a sufficient amount of food. LPAs reviewed the facility menu, and conducted interviews which revealed that children are still hungry and thirsty after meals. Interviews revealed that the facility will offer alternatives and includes additional components to give children more options. A review of the menu determined that the facility needs to update their menu and include all components to the meals that are being provided.

Based on the interviews and review of records the preponderance of evidence standard has been met, therefore the above allegations are found to be SUBSTANTIATED. Title 22 regulations are being cited on the attached 9099-D pages.

An exit interview was conducted with the Director. A notice of site visit was provided and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.

LPA Hunter informed Facility Representative, Rachael Kulling that this report dated 06/16/22 documents 2 Type A citations which shall be posted for 30 consecutive days as there are immediate risks to the health, safety, or personal rights of children in care.

Also, LPA Hunter informed the Facility Representative to provide a copy of this licensing report dated 06/16/22 that documents any Type A citations to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.
