On 03/14/24. Licensing Program Analysts (LPAs) Elvira Sierra and Fabian Schwartz met with the Licensee, Cristiane Aguilar for the purpose of an unannounced annual inspection. New facility hours of operation are M-F from 07:00 a.m. to 06:00 p.m. Licensee stated there are no new residents living in the home since licensure. Form (LIC 126), Entrance Checklist for Family Child Care Homes, was provided to Licensee. Upon arrival LPAs observed four children being supervised by Licensee's husband and son. Licensee and six more children arrived later during the inspection.
A health and safety inspection of all areas accessible to children was conducted and the following was observed. Home appears orderly and suitable for children. Licensee is requesting to make the backyard part of the daycare areas. New off-limits areas; All bedrooms, the kitchen, closet by the hallway area, laundry room, two storage units located in the backyard, and front yard. The licensee acknowledged that children may never enter these off-limit areas. Napping equipment and age-appropriate toys/play equipment were observed. The licensee stated there are no weapons in the home. No bodies of water were observed. A working telephone, 2A10BC fire extinguisher and functioning smoke and carbon monoxide detectors were observed at the home. The backyard is fenced for supervision. LPA observed two play structures in the backyard. LPA advised that structures must be used according to manufacture instructions. LPA observed wood bark under and around play structure to absorb the shock of falls. The licensee was advised that prior to making alterations or additions to the home or grounds, the licensee should notify the Department of the proposed changes. Facility provides meals and transportation for clients. Last fire drill was conducted last on 10/02/2023 and is properly documented.
LPAs reviewed three children’s files. LPA observed all required forms for the children in care are complete and maintained in the file. Current in person EMSA CPR and First Aid certification for the Licensee was verified and expires on 03/2026 and AB 1207 Mandated Reporter Training was verified for Licensee and expires on 05/30/24. LPAs observed a current roster.

Based on observation, interviews and record review, the licensee did not comply with the section cited above by having an assistant with no CPR certificate caring for the children while she was not present at home which poses a potential health, safety or personal rights risk to persons in care.

Licensee was explained that absences shall not exceed 20 percent of the hours that the facility is providing care per day. Licensee must notify the department anytime facility is closing for vacation or any other leave that requires to be absence more than 20 percent per day.

All individuals subject to criminal background review have obtained a criminal record clearance. Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.



Licenses acknowledge that a Plan for Providing IMS must be submitted to the Department if provided. Incidental Medical Services (IMS) policy was discussed. For IMS information see Evaluator Manual - Regulation Interpretations and Procedures for Family Child Care Homes Section 102417. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. LPAs discussed the safe sleep regulations with licensee, and discussed the Child Care Licensing Safe Sleep webpage at: https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep, as an additional resource. LPAs also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at: https://www.cpsc.gov/, and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

Licensee was made aware of the (LIC9227) Individual Infant Sleeping Plan, for infants under 12 months and sleep logs for all infants in care under 24 months need to be maintained in children’s files. LPAs discussed and provided an example of a sleep log.

Community Care Licensing Division (CCLD) regularly sends information to licensed facilities, providers, and stakeholders by way of Provider Information Notices (PIN), Program Quarterly Update Newsletters and other important information communication platforms. The licensee was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California.

During the exit interview, the LICENSEE, Cristiane Aguilar, confirmed that there are no Registered Sex Offenders living in the facility and LPA completed the RSO profile in FAS.

A notice of site visit was posted and must remain posted for 30 days. Exit interview conducted and this report and Appeal of Rights were reviewed and provided to the licensee, Cristiane Aguilar.
