On July 14th, 2023, at 9:20 AM, Licensing Program Analyst (LPA) David Nguyen conducted a complaint investigation visit and met with Director, Nadia Khan. The purpose of the inspection visit was to deliver the finding for the above allegation. LPA disclosed the purpose of the inspection and was granted entrance. LPA toured the facility and observed twenty (20) children being supervised by three (3) adults.

During the course of the investigation, LPA Nguyen conducted interviews with the Director, Teachers, Children, and Parents. In addition, LPA Nguyen obtained information pertaining to allegation and observed the care and supervision of the daycare children. It was alleged that “Staff allowed day care child to wander from the facility.” Interviews conducted revealed that there was time that facility staff allowed childcare children to wander from the childcare facility.

Based on the interviews conducted it was determined that the preponderance of evidence standard has been met; therefore, the above allegation is found to be SUBSTANTIATED. The following Title 22 Deficiency is being cited on the subsequent 9099-D page.

Upon receipt of Type A citation, the Director shall post and provide copies of the LIC 9099-D for parents/guardians of children in care and for parents/guardians of newly enrolled children for the next 12 months. Director must also keep the signed LIC 9224, acknowledging receipt of LIC 9099-D in each child's file.

An exit interview conducted, and report was reviewed with the Director, Nadia Khan. Appeal of Rights were provided. A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.00.

Staff Meeting will be held to focus on Supervision. Director will email LPA the sign-in sheet from this meeting. Director will create a written statement for staff to sign that describes discipline policy and procedures will be expected of staff for the future. Director will create a Transition Log for keeping track the number of children while they are in the teachers’ care.

Based on interviews conducted, it was revealed that facility staff allowed childcare children to wander from the childcare facility. This poses an immediate health, safety, or personal rights risk to children in care.

Licensing Program Analyst (LPA), David Nguyen conducted an unannounced field visit to deliver the findings for the above allegations. LPA Nguyen arrived at the facility and was met by Director, Nadia Khan. LPA Nguyen disclosed the purpose of the inspection and was granted entrance. LPA Nguyen toured the facility and observed twenty (20) children being supervised by three (3) adults.

It was alleged that the “Staff engaged in a verbal altercation and made inappropriate comments in the presence of day care children.” and “Staff speak aggressively and are not treating day care children equally.”

During the investigation, LPA, Nguyen inspected the facility and interviewed the Director, Teachers, Parents, and Children.

Based on the information obtained throughout the course of this investigation, the above allegations could not be substantiated or dismissed.

During the interviews, LPA Nguyen found conflicting information regarding the above allegations. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur; therefore, the allegations are UNSUBSTANTIATED.

An exit interview was conducted in which the report was reviewed and discussed with the Director, Nadia Khan. LPA Nguyen provided a copy of the report and Appeal Rights to the Director. A Notice of Site visit was posted by LPA and Licensee understands it must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.00.
