On November 4, 2022, Licensing Program Analyst (LPA) Elvira Sierra met with Director, Elizabeth Herrera and Licensee, Ervin Smith to deliver the findings of the complaint investigation regarding the above allegations. Present in the facility were 8 staff caring for 33 children.
During the course of the investigation, LPA Sierra conducted interviews with staff, parents, daycare children and obtained information pertaining to the allegations. It was alleged that staff is using inappropriate language while daycare children are present, demonstrated inappropriate form of punishment and denied a daycare child from using the restroom while in care. Through interviews LPA learned that redirection and at times "calm area" is used by the facility as a discipline policy. Staff stated that facility uses a space in the classroom that they call “the calm down area” and is used when a child is really upset and needs some time away from the rest of the children. Staff tells the child that once is ready and calm, child can come and join the rest of the group anytime and there is no time restriction. During visits conducted on 09/09/22, 09/27/22 and 10/14/22 LPA did not observe staff using inappropriate language while interacting with the children.

Staff interviews did not support the allegations and stated that facility has schedule times for bathroom use, however staff will take the child to the bathroom whenever he or she ask to use the bathroom. Interviews with children did not reveal any evidence to support the allegations. Parents that were interviewed stated that they have had only positive experiences with staff and have been able to observe staff interacting with children on multiple occasions.

Based on the information obtained throughout the course of this investigation the above allegations could not be substantiated or dismissed. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the findings are UNSUBSTANTIATED.

Exit interview was conducted. This report and Appeal of Rights were reviewed and provided to Licensee, Ervin Smith and Director, Elizabeth Herrera. Notice of Site Visit was posted and should remain posted for 30 days.
