13 | On 06/22/23, Licensing Program Analyst (LPA) Elvira Sierra met with Director, Elizabeth Herrera for an unannounced complaint investigation regarding the above allegation. Licensee, Ervin smith arrived later during the inspection. Present during the inspection was Director, five staff and one volunteer caring for 37 children.
During today’s visit, LPA inspected all areas accessible to children including the facility kitchen. LPA also conducted interviews with staff and daycare children. Complainant has reported that facility staff are not adhering to the posted menu. Interviews revealed that facility is not following the breakfast schedule menu. Even though facility is following meal patterns requirements, facility failed to update their breakfast menu. Facility was advised that any changes to the menu shall be in writing and shall be posted at least one week in advance for parental review.
Based on LPA interviews, the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED.
