On 9/4/2020, at 1:58 PM, Licensing Program Analyst (LPA) Gigi Reyes conducted an inspection to conclude a complaint investigation regarding the above allegations. Due to COVID-19 and Department of Public Health's guidelines pertaining to social distancing, a tele-inspection via facetime was conducte. LPA Reyes met with Director, Terry Del Giorgio. There were 18 day care children and 4 staff present during the inspection.

Regarding the allegation that Staff will not allow child's authorized representative to inspect child's record, LPA record review revealed that on June 5, 2020 Parent #1 (P1) emailed the director requesting for a copy of new contract. Director responded that there was no new signed contract or new contract to be signed and therefore nothing to provide.

Exit interview conducted with Director. A copy of the Appeal Rights (LIC 9058 FAS 01/16) was given and explained. Director's signature on this form acknowledges receipt of these rights.

Notice of Site Visit has been posted (LIC9213). The notice shall be posted for 30 consecutive days. Failure to maintain posting as required will result in a $100.00 civil penalty. LPA interview with the Director on 6/19/2020 and 8/27/2020 revealed there was no new parent agreement created because the tuition fee amount remained the same and only the schedule changed; In alternating week C1 will attend pre -school for 5 days, and 2 days the following week, per C1’s parents request based on their individual circumstances.

On June 8, 2020, The Director emailed P1 that a new Parent Agreement will be entered into stating the above schedule and its corresponding tuition fee. P1 did not agree with the Director's proposal based on the email response from P1 dated June 8, 2020 which states, " I would like my Child pulled from your program until there is a record on file showing P2 and I agree to C1's schedule as we both have equal rights and share equally on the bills."

On 9/2/2020, LPA interview with P1 revealed that P1 wanted C1 to attend day care for two (2) days only every week concerned of the tuition fee that P1 and P2 will share, a request beyond Director’s control.

Regarding the allegation Staff is prohibiting child's authorized representative to enter the childcare center when the child is present, LPA record review revealed that on June 10, 2020, 4:48 pm, P1 emailed Director asking for gate code to enter the day care and secure copies of C1's record. Director responded via email Director will meet P1 at the gate after the Preschool closed.
On 8/27/2020, LPA interview with Director revealed that Director did not allow P1 to come to preschool during business hours to inspect C1's records because of P1's hostility in emails and social media which may cause unnecessary distraction during school hours.

Further, on June 11, 2020 letter to parents of C1, Director terminated C1 contract effective close of business day on June 12, 2020. Director refunded the full tuition fee paid by P2.
On July 2 to July 10, 2020, LPA Velazquez interviewed parents of day care children and none of the parents corroborated with the allegations.
