Regarding the allegation, lack of supervision resulting in day-care child sustaining unexplained injury. Complainant reported that during a pick up time (date was not definite) complainant had seen Child 1 on top of a play structure and no one was near child 1, two staff were standing 300 feet away from the structure. Complainant stated that complainant had no references Child 1 was in danger during that time, complainant was not certain if that was a one time or had been happening. However, a complaint was filed because complainant had observed scratches on child 1 on several occasions and it was not cleared to complainant the cause of the injury.
Investigation consist of LPA's observation, interview of staff, director, parents of current and previously enrolled day care children and pre school children. Interim director stated that director ensures staff are within the the play structure area. LPA interviewed 8 parents and 7 out of 8 parents did not corroborate with the allegation, 7 parents have no concern on care and supervision and these parents have observed staff are always near the play structure. During the 3 inspections conducted by LPA on 3/11/2019/, 3/28/2019 and 5/30/2019, it was observed that a teacher or two were close to the play structure when children are in the play ground.
Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation(s) did or did not occur, therefore the allegation is unsubstantiated.
On today's visit, no deficiency was cited. Appeal Rights given.
