Licensing Program Analysts (LPA's) Glenn Schnell and Marie Rodriguez conducted a complaint investigation inspection today for the purpose of delivering the findings to the above allegations. During the inspection of these allegations on multiple dates (June 19 and July 1 2019), LPA's toured the facility, conducted an evaluation of teacher child ratio, qualifications of staff, and care and supervision of the children. LPA's also reviewed facility records related to staff time sheet reports, authorized representative sign in/out logs, classroom attendance sheets, and child head count reports tracked by staff. LPA's discussed the above allegations with Assistant Director Janice Knight today.

Regarding the allegation of children being left unattended without direct visual supervision by staff; It was reported to the LPA's that there were at least three occasions observed on April 17, April 19 and on June 3, 2019 of children being left unattended. Only one of the three dates, April 19, was able to be confirmed by Director Engram as a possible date of occurrence, and this was during a special event at the facility that parents were invited to attend. For the dates of April 17 and June 3, those observations were reported to have occurred during transition times when classrooms were either combining or children were moving from indoor to outdoor play. LPA's were unable to corroborate any information provided for the three occasions to determine that children were left unattended without direct visual supervision by a teacher.

Regarding the allegation of the facility operating out of ratio; This involved observations of staff taking breaks during periods when children were sitting at tables eating snack, leaving the classroom out of ratio. There was also another observation of a teacher and an aide working with at least nine children and up to 14 children. LPA's were unable to corroborate any information or statements to determine that the facility was operating out of ratio.

Regarding the allegation of unqualified staff supervising children; This involved observations made on multiple dates of aides working alone with and supervising the children (other than aides being allowed to assist children with toileting/diapering and supervising children at nap time). LPA's were unable to corroborate any information or statements to determine that unqualified staff were alone in classrooms supervising children.

LPA's discussed with Director Engram the protocol and policies in place to ensure that children are adequately supervised and by qualified staff at all times. Engram states that when staff have planned days off, call in sick or are running late to report for their shift, there are a number of resources to utilize; management staff will cover in classrooms, ,qualified staff will be reassigned from other classrooms, Child Care Careers will be called for substitutes, and/or their sister center in San Mateo will be called to inquire about available staff.

Although there were no deficiencies identified regarding the above allegations during today's inspection as well as previous inspections, LPA's are unable to determine whether or not there were any incidences of children being left unattended by staff, operating out of ratio, and whether unqualified staff are in classrooms to supervise the children with no qualified staff present.

Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegations are unsubstantiated. A copy of this report and appeal rights were reviewed and provided. Notice of Site visit was observed to be posted and shall remain posted for 30 days.
