Licensing Program Analysts (LPAs) Glenn Schnell and Leslit Tapia-Mandujano met with Linh and Kaitlynn Tran to conduct a case management- capacity increase inspection. The licensees have applied for a large family child care license. The type of home is a single-family house. The licensees state this is their primary residence where they live full time. Licensees state that they understand that they are the primary persons responsible for operating and providing care and supervision to the children, regardless if the licensees hire helpers or assistants to work with them. Licensees understand that they may only be absent from the home no more than twenty percent of the operating hours as stated on the submitted Application for a family child care license. During the twenty percent absence licensees understand that they may designate another person to provide care and supervision to the children who is qualified with Mandated Reporter Training, Pediatric CPR and First Aid Training, has obtained criminal record clearances, child abuse index checks, a TB test with results, immunization's as required by law, and has a signed Criminal Record Statement and Acknowledgement to Report Suspected Child Abuse forms. During today’s inspection, LPAs toured the home and yard, and reviewed the required day-care forms with the applicants. Present in the home today are licensees Linh and Kaitlynn Tran with 4 preschool children. Adults living in the home are Linh and Kaitlynn Tran. LPAs confirmed that Andrew Tran does not live in the home, but occasionally will work as an assistant/helper, and does sometimes visit or stay overnight. LPAs reminded Linh and Kaitlynn to maintain a file at the facility for Andrew with all required documentation.

A review of records indicates that all adults working or living in the home who require caregiver background checks have received criminal record and child abuse index clearances or exemptions. Off limit rooms of the home were identified as bedroom #1, bedroom #2, and bathroom #3. Licensees rent home and have approval of the landlord to operate a family child care home. Licensees possess proof of control of property and provided a Lease Agreement. Capacity and ratio options was reviewed with the licensees today. Licensees have landlord permission to care for two additional children (6 years plus in age and one of the two children can count if they are enrolled in Kindergarten) and must also notify the parents if care is being provided to the two additional children. The daycare operates 7:30am-5:30pm, Monday through Friday. Licensees require parents to sign the affidavit for liability insurance or obtain adequate liability insurance.

LPAs observed the following today:
-Daycare area is clean, orderly, and equipped with age appropriate toys and equipment for the children. No baby walkers, bouncers, exercausers, etc. allowed to be used during day-care hours.
-Home has proper lighting and ventilation. Home has a working telephone, a working smoke and carbon monoxide detector, and a fully charged 2A10BC fire extinguisher.
-There are no bodies of water on the property. There is not a fireplace in the daycare area. There are no detergents, or cleaning products accessible to daycare children. Poisons are locked. Applicants stated there are no guns or weapons of any kind in the home.
-The yard is fenced.
-There are no pets in the home.

Linh’s CPR and First Aid expired on 09/2020. Kaitlynn’s CPR and First Aid expires on 01/2022. Licensees understand emergency drills must be conducted at least once every six months and properly logged. Licensees provide daily snacks and meals. Discipline used will be redirection. Isolation of sick children has been discussed. Children’s roster was reviewed and will be maintained as required. Records for Children and staff/helper files were reviewed. Care and Supervision and transportation of children was discussed. Licensees will not be providing transportation. Visitors to the home was discussed. Capacity options were reviewed. Licensees understand that care cannot be provided for more than the capacity as stated on the license. Licensees understand that their own children under the age of ten will count in the day-care ratio, including any foster or adopted children. Requirements for reporting suspected child abuse was discussed, as well as reporting requirements for unusual incidences. All required postings are properly posted (License/Parent’s Rights poster/Emergency Disaster Plan and Earthquake Preparedness Checklist). Licensees have updated immunization's; however, the flu vaccine needs to be current for both licensees. Licensees have current Mandated Reporter Training on file. Incidental Medical Services (IMS) policy was discussed. Licensees are providing IMS for one child in care. Storage and administration of the medication was discussed. Licensees were reminded that as of September 1, 2016, a person may not be employed or volunteer at a child care facility unless he or she has been immunized against influenza, pertussis, and measles or qualifies for an exemption pursuant to Health and Safety code 1596.7995 and 1597.662.

Licensees were informed about the Provider Information Notices (PINs) on CCLD website.

LPAs Schnell and Tapia-Mandujano inspection included providing the licensees with the COVID-19 self-assessment guide. LPAs also reviewed COVID-19 required postings and provided additional COVID-19 resources to licensees. LPAs reviewed this guide with the licensees and requested the guide be completed and returned to LPAs as part of completing the application process for an increase in capacity. Licensees were informed that access to available Personal Protective Equipment (PPE) may be available through the local child care resource and referral agency.

Licensees were reminded about Mandated Reporter Training available on CCLD website. Training is valid for two years. (www.ccld.ca.gov or www.mandatedreporterca.com)

Licensees were advised of the changes to regulations regarding ‘Safe Sleep” and provided with handouts regarding “safe to sleep best practices”. Each infant will also be required to have on file an Individual Infant Sleeping Plan (LIC 9227). Lead Flyer Requirement Health and Safety Code 1596.7996, mandated that, effective January 1, 2019, CCCs and FCCHs are required to provide parents and guardians of children enrolling or re-enrolling in care with written information on the risks and effects of lead exposure, blood lead testing requirements and recommendations, and options for locations of affordable blood lead tests as specified. A Lead Poisoning Facts Flyer was created, in partnership with the California Department of Public Health (CDPH), to satisfy this requirement. This flyer must be provided to parents and guardians upon enrolling or re-enrolling any child in care.

Licensees were reminded that effective July 1, 2020, child care providers are now required to complete EMSA certified Lead Poison Training. A list of approved trainers can be found at https://emsa.ca.gov/childcare_provider1/

During today’s inspection LPAs received an updated Emergency Disaster Plan and Criminal Record Statement from Linh and Kaitlynn Tran.

The following corrections will be necessary before a license to operate a large family child care license can be recommended:
-Completion of EMSA Certified Lead Poison Training for both licensees
-Updated Flu vaccine or declaration to opt out for both licensees
-CPR and First Aid Renewal for Linh
-Proof of completed Criminal Record Statement for Andrew Tran
-Incidental Medical Service (IMS) Plan
-Fire Safety Clearance
-Copy of this signed Facility Evaluation Report signed by both licensees
-Covid-19 Self-Assessment
