On December 15th, 2022 at 2:15 PM, Licensing Program Analyst (LPA) Rosie Breault conducted an unannounced Case Management inspection to follow-up on an Action Level Exceedance (ALE) reported to the Regional Office by the Director. LPA met with facility Director Julie Summer and site supervisor Ginny Tymon and advised her the purpose of the inspection. Director provided LPA a tour of the facility. At time of the inspection there were thirty-three children present.

Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018, requires all licensed Child Care Centers (CCCs) constructed before January 1, 2010 to test their drinking water for lead contamination between January 1, 2020 and January 1, 2023, and then every five (5) years after the date of the first test. If the water testing results indicate that the facility has an ALE, an immediate response shall be required pursuant to section 101704, which may include remediation.

The Regional Office received an ALE for two (2) sites. The Center notified a LPA at Community Care Licensing (CCL) of the results on December 5th, 2022 by phone. Director advised LPA site E (hand washing sink in Room 10) tested 14.9 ppb. Upon review of sink and sampler's report during inspection, LPA noted this sink had a new faucet placed on prior to testing. Director contact a plumber prior to advent of testing procedures to fix a possible issue with the faucet. The plumber advised to replace it in its entirety. Director replaced faucet with lead free device. After installation, upon testing, sampler flushed and detected 14.9 ppb. However sampler immediately conducted a second flush which registered at 1.09 ppb making it under the threshold for lead. Director advised LPA during inspection, drinking sink (site K) in the infant yard tested 7.63 ppb and LPA confirmed information with report. Prior to testing during same visit with plumber, plumber removed drinking mechanism on site K, leaving only hand washing station mechanism which was never used due to the height of the sink and age of the infants. Upon report, director capped off the hand washing mechanism for proactive prevention. The drinking sink is fenced off in its' own play yard and cannot be reached by any children other than infants who have complete inaccessibility. Staff has consistently issued filtered water.

Per PIN 21-21-CCP, the following outlet locations should be sampled: cold water faucets and fountains, cold water side of single-handle and dual-handle faucets that dispense both hot and cold water, filtered water dispensers, and water dispensed by refrigerators used for drinking and cooking water. ALE site K should not have been tested due to inaccessibility, removal of device prior to. Staff continues to provide bottled water.
