25 | On 11/03/2022, at 2:00 PM, Licensing Program Analyst (LPA) Gigi Reyes conducted an unannounced Case Management inspection to follow-up on an Action Level Exceedance (ALE) reported to the Regional Office by the Division of Drinking Water (DDW), LPA met with Director Barbara Wilson and explained the purpose of the inspection. Director provided LPA a tour of the facility. There were 16 children in care at the time of the inspection.
Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018, requires all licensed Child Care Centers (CCCs) constructed before January 1, 2010 to test their drinking water for lead contamination between January 1, 2020 and January 1, 2023, and then every five (5) years after the date of the first test. If the water testing results indicate that the facility has an ALE, an immediate response shall be required pursuant to section 101700.3, which may include remediation.
The Regional Office received an ALE for four (4 ) water outlets in this facility. The Center was notified by LPA Reyes of the results on October 26, 2022 by phone. LPA advised Center director that four fixtures, labeled A, B, E, & G exceeded the 5-ppb action level. The said fixtures are bottle fillers and bubblers that have an ALE level of 6.8, 5.7, 6.2 and 5.6 respectively while the remaining five fixture first draw samples were less than the action level of 5 ppb. Director informed LPA that the 2 classrooms where fixtures with ALE exceedance the classroom are not being occupied.
During today’s inspection, LPA toured the entire facility and inspected the outlets in question. LPA observed that the affected fixtures are wrapped with clear plastic and labeled "Do not use until further notice" Director stated they have not been using the bottle fillers nor the bubblers because the children bring their own refillable water bottle and Center has a 3 gallon and sealed water bottles to refill the children's water bottles.
