On May 11, 2023 at 10:00 AM, Licensing Program Analyst (LPA) GIgi Reyes conducted an unannounced inspection to conclude the complaint investigaton on the above mentioned allegations. LPA met with Director Sally Smith and discussed the purpose of the inspections. There 32 children present and 7 staff present.

This report details the investigation into an unsubstantiated complaint against day care staff for refusing to change a child's soiled clothing, forcing the child to nap. Tthe complaint was received by the Department on February 17, 2023 which alleged the incidents occurred at the above CCC, date/s were not provided of the alleged incidents.

As part of the investigation the following actions were taken: Interview with the complainant on 3/10/2023. The complainant alleged that when parent of child# 1 picked up the child (on 3 consecutive days) from the day care center, parent noticed that the child’s clothing was soiled. The parent claims that they asked why C1's clothing was not changed, Staff # 1 allegedly responded that C1 intentionally wet C1's self thus, S1 refused to change C1's clothing.

On March 10, 2023, LPA Reyes interviewed Staff 1, the day care staff denied the allegation of refusing to change the diaper. Staff 1 stated that when parent of C1 came to pick up, C1 just had an accident moment before parent arrived and Staff 1 was about to change C1's clothing. On 3/10/2023, LPA Reyes interviewed all Staff regarding clothes changing policy. All staff check each child on a regular basis and immediately change the soiled clothing to ensure that children are comfortable. It was also noted that it is a CCC policy, that children are required to be potty trained to be enrolled.

The complainant also alleges that the day care staff forced the child to nap, despite the child not being tired. Interview with all Staff members, (4) revealed that during nap time, if a child refuse to nap CCC offers the option to read, color or lay quietly. Director stated that there is a classroom dedicated for children who are unable to nap. CCC likewise offer a half-day for non-nappers.

Regarding the allegation of disclosure of private information about a child, inasmuch as the Director denied the allegation, the individuals who were allegedly involved have no connection with the CCC.

LPA interviewed parents of currently and previously enrolled day care children, none of the parents corroborated with the allegations. They do not have concern on children's personal rights and are satisfied with the care and supervision their children receive/d from CCC staff members

Although the above allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegations are Unsubstantiated. Appeal rights were given and explained.

Notice of Site Visit has been posted (LIC9213). The notice shall be posted for 30 consecutive days. Failure to maintain posting as required will result in a $100.00 civil penalty.
