Licensing Program Analysts (LPAs) Ruth Gull and Eric Lin made an unannounced CASE MANAGEMENT inspection to the center. Met with Susana Del Toro, Director regarding an incident that was self reported on 07/31/19. LPAs interviewed Director; toured the center and observed the area where the incident occurred; and obtained copies of pertinent documents.
The incident occurred on 07/30/19 at approximately 4:30pm on the playground. Teacher #1 was with 11 children who were lined up preparing to go inside. Child #1 hit and pushed Child #2. Teacher #1 instructed Child #1 to stop and Teacher #1 attempted to hold Child #1's hand and walk Child #1 away from Child #2. Child #1 continued to try and hit Child #2 and pulled Teacher #1 causing her to almost fall. Teacher #1 then grabbed Child #1's right upper arm in order to better control Child #1's actions. Child #1's parent then arrived to pick up Child #1 and observed Teacher #1 grab Child #1's right upper arm. Child #1's parent reported the incident to Director Del Toro. Child #1 and Child #2 did not have any apparent injuries. Teacher #1 left on 07/31/19 for a scheduled vacation (through 08/09/19). Teacher #1 returned to work on 08/12/19 and was placed on suspension until 08/16/19. Teacher #1, Director and another teacher are scheduled to complete a Nonviolent Crisis Intervention training in September 2019 (other teachers will also receive the training in future months). Teacher #1 will also complete Mandated Reporter re-training. On 07/31/19, Director Del Toro met with all teachers and reviewed children's personal rights.


Pursuant to Title 22 of the CA Code of Regulations, the following Type B deficiency was cited (refer to LIC 809-D). Civil Penalties were assessed in the amount of $250.00 as the same Personal Rights violation was cited on 10/30/18.
Exit interview conducted. Today's reports were reviewed and issued. The Director was provided a copy of their appeal rights (LIC 9058 12/15) and their signature on this form acknowledges receipt of these rights.
The LIC 9213 (Notice of Site Visit) was posted during today's visit.

Licensee suspended Teacher #1 on 08/12/19 (after Teacher #1 returned from vacation 07/31/19 - 8/09/19). Teacher #1 will return to work on 08/16/19 and will be scheduled to complete a Nonviolent Crisis Intervention training in September 2019. Teacher #1 will also complete Mandated Reporter re-training. on 07/30/19, Teacher #1 grabbed Child #1's right upper arm (because Child #1 was trying to hit Child #2 again). Child #1 and Child #2 did not have any apparent injuries. This poses a potential risk to the safety of the children in care.
Repeat Violaiton Immediate Civil Penalty Assessed $250.00.
