32 | During the investigation, LPA inspected the kitchen and observed an active ant infestation. LPA observed ants on the counters and a plate. LPA observed there was no food being prepared or food that had been left out. Ants were not observed in other areas of the kitchen. Site supervisor acknowledged there was an active ant infestation and had already called the maintenance staff to ensure compliance. LPA reminded site supervisor of the Healthy Schools Act regarding pesticide safety and timely notification.
Based on LPA's observation and evidence gathered, the preponderance of evidence standard has been met, therefore the above allegation is determined to be SUBSTANTIATED.
As a result, one Technical Violation is being issued today under California Code of Regulations, Title 22, Division 12. This report must be made available to the authorized representatives of children in care and maintained in the facility file for three years.
An exit interview was conducted with the site supervisor Maite Estrada. Copies of the Appeal Rights and the Notice of Site Visit (LIC 9213) were provided. The Notice of Site Visit must remain posted in a visible location for 30 consecutive days. Failure to comply with posting requirements will result in a $100.00 civil penalty.
