On November 3, 2023 Licensing Program Analyst (LPA) Susana Martinez conducted an unannounced required 3 year inspection. LPA met with Licensee Alma Garcia and advised her the purpose for the inspection. Together with Licensee, LPA toured the home inside and outside. At the time of inspection there were 3 children present and two adults in the home. No bodies of water were observed at the time of inspection. Licensee denies having guns/ammunition in the home.

The Licensee operates M-F 6 AM- 5 PM. Licensee uses living-room, dining room, kitchen, one bathroom, and enclosed back yard for day care use. LPA observed required licensing documents mounted on the walls throughout the home. Last fire/disaster drill was conducted on 10/12/2022, LPA reminded Licensee that fire/disaster drills must be conducted and documented every 6 months. Fire extinguisher 2A10BC mounted on the wall inside the laundry room was last serviced 10/20/2022. During the inspection Licensee contacted her local fire department and set up an appointment to service the fire extinguisher on Mon 11/6/23 at 1 pm. Smoke detector was observed to be located in the living-room. The carbon monoxide detector located in the kitchen was tested at 11:41 AM and found to be working.

Fire place inside the living room is screened to prevent access by children. Kitchen knives are being kept in a cabinet above counters to keep out of reach from children. Children have access to toys that are age-appropriate inside and outside of the home. Back yard play area is enclosed and has plenty of bicycles, scooters, and activities. During the tour, LPA did not observe any hazards/toxins items accessible to children in care.

LPA reviewed three out of three children files. Two out of three children's files were current. Licensee states that C1 just started attending today, and therefore that is why child does not have complete file. LPA reminded Licensee that children's files should be completed by enrollment. Licensee states the mother was in a rush the day prior and did not want to take the forms. Licensee states she will have the mother complete the documents today.

LPA observed a large trampoline in the backyard.
Licensee was advised of the dangers regarding children playing on a trampoline. Licensee agreed to the following:
TRAMPOLINE CONDITIONS:
1. Follow appropriate age limit and warnings designated by manufacture when using the trampoline.
2. There will be one fully qualified adult and/or the licensee directly and in the presence of children playing on the trampoline. The licensee may be one of the adults supervising the children.
3. If children are in care who are not using the trampoline, those children shall be supervised by a qualified adult.
4. The licensee shall inspect the trampoline on a daily basis and immediately before its use to ensure its safety and that it is in good repair and condition.
5. The trampoline shall only be used in a safety cushioned area.
6. If there are any injuries as a result of the use of the trampoline requiring medical attention, the licensee is required to report this incident to the licensing office within 24 hours by telephone followed by a written report (LIC 624 B) within 7 days from the day of the incident.

Licensee CPR/first aid is valid through 10/11/2025. Licensee was reminded a licensed child day care provider, administrator, or employee of a licensed child day care facility shall complete the mandated reporter certification AB1207 every two years at www.mandatedreporterca.com. Licensee states she does not know what that is. Licensee was issued a citation in the past for missing mandated reporter. LPA provided mandated reporter information in Spanish.

Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated.

LPA discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.
Incidental Medical Services (IMS) policy was discussed. For IMS information see PIN 22-02- CCP. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. The following information regarding ADA was provided: US Department of Justice (USDOJ) toll-free ADA Information Line at (800) 514-0301 (voice)/ (800) 514-0383 (TTY) and link to publication: Commonly Asked Questions about Child Care Centers and the ADA, available at: https://www.ada.gov/resources/child-care-centers/.
Licensee was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California.

During the exit interview, the LICENSEE Alma Garcia, confirmed that there are no Registered Sex Offenders living in the facility and LPA completed the RSO profile in FAS.
LPA provided the following resources:
- Mandated Reporter Training instructions (in English and Spanish)
- Pictorial handout on items not permitted in the home.
- Safe Sleep FAQ's (in Spanish) and Sleep Log
- Forms/Record to be kept in your family child care home (LIC311D)

During today's inspection two Type B citations were issued and can be found on the attached 809-D. Two Technical Violations were also issued:
Type B: Missing mandated reporter training certification: HSC 1596.8662(b)(1)
Type B: No fire/emergency disaster drills: CCR 102417(g)(9)(A)
Technical Violation: Fire Extinguisher per CCR 102417(g)(1)
Technical Violation: Children's Records per CCR 102421(a)

A notice of site visit was given and must remain posted for 30 days.
Exit interview conducted, appeal rights provided and report was reviewed in Spanish with the licensee Alma Garcia.
