This is an amendment to 07/11/2023 inspection to include full allegation.
On July 11th, 2023, at 3:28pm Licensing Program Analyst (LPA) Rosie Breault, made an unannounced inspection to conclude a complaint allegation that was initiated on March 20th, 2023. LPA met with Director Jacqueline McDonough and explained the nature and purpose of the inspection. Director provided LPA a tour of the facility both inside and out. At the time of the inspection there were twelve (12) children and four (4) staff present.
The Department obtained an allegation that a staff member (S1) posted pictures of children’s faces on a social media site, accessible to the public. S1’s social media profile was of a sexual foot fetish nature.
This allegation was investigated by the Department’s Investigation Bureau (IB). During the course of investigation, it was revealed S1 took photos of own feet during children’s nap time. In the photographs, several daycare children can be seen in the background sleeping on their cots. The name of one of the daycare children is clearly labeled on the cot and C1’s name legible in the photograph. S1 acknowledged to IB of having an adult foot fetish and a public foot fetish social media page. S1 also acknowledged taking the photographs but stated S1 did not intentionally include the daycare children in the photographs. S1 stated S1 did not realize the children could be seen in the photographs and admitted it was an error in judgment. During the investigation, S1 removed the photographs containing the daycare children from S1’s social media page.
Based on the investigation of IB, the preponderance of evidence standard has been met, therefore the allegation is SUBSTANTIATED. Health and Safety Code 1596.885 (c) and a B violation has been cited.
Exit interview was conducted with Director and Appeal Rights provided. Notice of Site Visit (LIC 9213) posted during LPA inspection and must remain posted for 30 consecutive days. Failure to maintain posting as required will result in a civil penalty of $100.00.
