32 | To prevent any similar incidents, the Licensee has placed the play structure off-limits and is planning to discard of it. LPA observed a torn off sticker on the play structure and could not determine the age limits on the structure. LPA asked Licensee if she had the manufacturers instructions, Licensee states she threw them away.
Licensee states she purchased the toy structure off of Amazon. LPA asked for proof of purchase, which Licensee provided. Together with the Licensee, LPA observed the play structure is a Qaba Caterpillar Climbing Tunnel for kids ages 3-6 years of age. LPA reminded Licensee to verify the manufacturers recommended age on all play structures. C1 and C2 involved in the incident are both under 3 years of age. Licensee states they usually separate infants from older children to prevent such accidents. LPA did observe baby gate separators.
Given the incident was observed by staff who took appropriate action by contacting the Department and reporting the incident, no deficiencies are being issued as a result of this incident.
A technical advisory is being issued during today's inspection for CCR 102423(a)(2) which states: (a) Each child receiving services from a family child care home shall have certain rights that shall not be waived or abridged by the licensee regardless of consent or authorization from the child's authorized representative. These rights include, but are not limited to, the following: (2) To receive safe, healthful, and comfortable accommodations, furnishings, and equipment.
A notice of site visit was given and must remain posted on, or immediately adjacent to, the interior side of the main door for 30 days.
