On 11/22/2021, at 11:16 AM, Licensing Program Analyst (LPA) Gigi Reyes conducted an unannounced Case Management inspection. LPA asked Pre screening questions related to COVID 19, Licensee's response indicates there was no COVID 19 exposure on site. There were 5 children present including Licensee's child.

On 11/18/2021, during the course of a complaint investigation, it was reported that Licensee was using the garage for Zoom Classes of school age children. Garage is an off limit area in the Family Child Care Home, Licensee admitted that due to number of school age children in her day care taking zoom classes( during the school closure), Licensee was constrained to resort to the use garage to accommodate the children's need of space and privacy.

On 11/22/2021, LPA toured the garage that can accommodate 3 vehicles. LPA did not observe any hazardous items such as poisons, detergents, cleaning compounds and other items which could pose a danger if readily available to children. Garage was observed to be clean, and in order. Arts and crafts materials and one parked vehicle are found in the garage.

On 9/29/2021, LPA Reyes interviewed Child 1, Child 1 stated Child 1 was locked alone in the garage by another child, (Child # 21) On the same day, LPA interviewed Child # 2, Child # 2 stated that Child # 1 usually runs into the garage when displaying tantrums.

On 11/18/2021, LPA Reyes interviewed Child # 2 who stated that a school age child (C2 was not able to identify the child by name) locked Child #1 and Child # 2 in the garage child while attending the Zoom Class.

LPA interviewed 4 school age children (Child 3, Child 4, Child 20 and Child 21) none of the children admitted the claim. The 4 children stated that Child 1 and Child 2 and Child 23 held the Zoom Classes in the garage but no children were locked in the garage.

LPA interviewed Licensee on 11/18/2021 and 11/22/2021, Licensee stated that no day care child was locked in the garage, that there was no occasion children were left alone and unattended.

Licensee stated she is aware that garage is off limit area and day care children should not be using it. LPA asked if Licensee would like to make the garage accessible to day care children. Licensee stated she will keep the garage under off limit area and will ensure that no children will be entering the off limit area. LPA reminded Licensee that off limit areas should be made inaccessible to day care children at all times.

Technical Violation under 102423 (a)(2) To receive safe, healthful, and comfortable accommodations, furnishings, and equipment was issued

Exit interview conducted with Licensee, Adriana Lopez. Notice of Site Visit has been posted (LIC9213). The notice shall be posted for 30 consecutive days. Failure to maintain posting as required will result in a $100.00 civil penalty.
